Thank you for your information request, reference number NELC/30798/2425.
I can confirm that North East Lincolnshire Council holds the following
information:

Please could you kindly supply all information on humberston fitties
regarding Tingdene notification to you regarding changes to the chalet
park what permission have you given to them to sell the empty green spaces

No notification has been received in respect to any changes to the Chalet
Park, any changes therefore would not affect the Permitted Use clause
within the lease. There has been no permission required to lease the
former plots.

Councilor Matthew Patrick stated at the meeting on 15th March 2017 the
cabinet meeting of the disposal of Humberstone fitties, which at 14:13 PM.

He has also highlighted that any changes to the park that the new
leaseholder may want to make would have to be notified to the council, and
they would work to ensure the interests of the residents are met.

Please can you provide all emails and all the information contained in
this statement above From Tingdene to NELC regarding the changes they made
to Humberstone fitties chalet park since 2017 to 2024

In the minutes of the Cabinet meeting on the 15th March 2017 there is no
mention of Cllr Patrick’s comments and therefore no information is held in
relation to this part of your request.

Please note however, the only time Tingdene would need to request
Landlord’s permission is if there were material changes that affect the
Permitted Use clause in the Lease. No material changes have been made,
therefore the Council does not need to be notified.

And one more clarification is required on Humberstone fittie below please
advise if Humberstone fitties is a Chalet park if so what right has
Tingdene have to change to Holiday Park, and did Tingdene infrom
yourselves regarding the change

The classification of Humberston Fitties reflects the planning permission
granted on the 25^th June 1992 when extending the seasonal opening and
operating period of the park, which refers to “Continue the use of land
for holiday purposes..”; the Permitted Use within the lease to Tingdene
states: “use as a chalet park and yacht club and as ancillary thereto car
parking, reception, management services and such other purposes provided
for the benefit of users and occupiers of the Property”.

Further to your request an internal review has taken place into North East
Lincolnshire Council's handling of your information request reference
NELC/30798/2425.

I have reviewed the response provided to you and the handling of your
request in accordance with the Freedom of Information Act and find:

• That your request was responded to within the statutory time of 20
working days;
• That you were informed whether or not the information you asked for
was held by North East Lincolnshire Council;
• That you were provided with the available information you asked for or
provided with the reasons why any information you had asked for could
not be supplied; and
• That your response provided you with your rights of appeal. 

I am therefore satisfied that the Council has acted in accordance with its
statutory duties in the handling of your request.

I can however further confirm that the minutes are not a verbatim record
of the meeting. The minutes would have been submitted to Cabinet for
agreement and then to full Council for approval and there was no request
to amend the minutes. A member of the Democratic Services team would have
been present at the meeting and taken notes but these are to assist with
the compilation of the minutes and our practice is to destroy notes once
the minutes have been approved by full Council.  As such we cannot verify
the comments made on a third party blog.
