First please can you provide the cost for raising of the banks between 2nd Avenue DN36 4HD and St Anthony bank Road from 2017 to 2023 which is dike that runs from the entrance of the site to the bottom of the site.
Did the leaseholder of the site provided any money towards this and please can you supply all costing which the leaseholder of humberston fitties has paid
from 2017 to 2023

We have considered your request under the provisions of the Freedom of
Information Act 2000 / Environmental Information Regulations 2004 (EIR).
The Act requires that we respond to requests by advising you whether or
not information is held, and if so by providing you with that information.

 

EIR Regulation 3(2) states that information is held if it is in our
possession and has been produced or received by us, or it is held by
another person on our behalf at the time the request is received.

 

Information not held

In this case, the information you have requested is not held by us.  The
Environment Agency have not undertaken any bank raising works at this
location and we have not had any funding from the leaseholder.  Therefore,
we are refusing your request on the grounds that there is no information
we can provide.

 

Where a request is for environmental information, the Regulations allow us
to refuse to disclose it if the exception at EIR Regulation 12(4)(a)
applies. The regulation states that a public authority may refuse to
disclose environmental information to the extent that it does not hold
that information when an applicant’s request is received.

 

It is not possible for us to conduct a public interest balancing test
because the reason for non-disclosure is that the information is not
held. 

 

Rights of appeal

If you are not satisfied you can contact us within 2 calendar months to
ask for our decision to be reviewed. We shall review our response to your
request and give you our decision in writing within 40 working days.

 

If you are still not satisfied following this, you can raise a concern
with the Information Commissioner, who is the statutory regulator for
Freedom of Information and the Environmental Information Regulations.  The

RE: Internal review of request for information under the Freedom of
Information Act 2000 (FOIA)/ Environmental Information Regulations 2004

Further to your e-mail dated 26 October 2023 you requested an internal
review of our handling of your FOI request relating to the Humberstone
fitties. Despite not meeting the official criteria for an internal review,
your case has been carefully evaluated and our findings are shown below.

 

Request details

 

We, the Environment Agency received the request CCN/2023/327704 on 24
September 2023 and we acknowledged receipt on 26 September 2023. 

 

On 23 October 2023 we apologised for the delay in responding within the
deadline and on 26 October 2023 you requested an internal review due to
our missed deadline.

 

On 7 November 2023 we wrote to advise that no works were carried out by
the Environment Agency at the location of interest.  This being the case,
there was no data we could provide. We again apologised for the delay and
any inconvenience this may have cause you.

 

Conclusion of the Evaluation

 

Service levels

I found that we did follow our internal EIR/FOI procedures and that we did
not comply with our duty to respond within the statutory timescales.

 

We apologise for our failure to comply with the time limited, which was
caused by the availability of our technical team to investigate the matter
raised and review whether any data was available.

 

We appreciate your patience and trust this resolution meets your
expectations.
