As I'm sure you're aware, the Freedom of Information Act 2000, Section 8 states -

"8.—(1) In this Act any reference to a “request for information” is a reference to such a request which—
(a) is in writing,
(b) states the name of the applicant and an address for correspondence, and
(c) describes the information requested.

Your request for information has not been processed as the request in anonymous (see b above). The links included in the e mail to letters etc have been redacted. Therefore, the Police and Crime Panel is unable to respond as per Section 8 of the Freedom of Information Act 2000.

With regards to the question you ask of the Humberside Police and Crime Panel (PCP), I can provide the following response -

Question - Does Humberside Police and Crime Panel hold any relevant information for a person dissatisfied with the Commissioner's conduct to have him made accountable?

Answer - The Humberside Police and Crime Panel does not hold any information on the Humberside Police and Crime Commissioner.

However, were an individual and / or group to make a formal complaint against the Police and Crime Commissioner, then the PCP has a duty to investigate that complaint (unless the complaint is in relation to an item identified in paragraph 7.1 and 7.2 of the procedure). For your information, I attach a copy of the Panel's complaints procedure.

The procedure explains how a complaint can be made. The procedure also explains in what circumstances a complaint will not be investigated.

Dear Matthew Nundy,

Thank you for providing the information setting out how members of the public are dictated to regarding what they can and can not be aggrieved about. I have not needed to do more than briefly look at the content to arrive at the conclusion that it is a statutory complaints procedure (in other words a sham) devised by the government to ensure the taxpaying public have no rights and will ultimately waste anyone's time who engages in the process.

I have already alerted the IPCC about the Police and Crime Commissioner refusing to record a complaint made about the Chief Constable of Humberside Police under the Police Reform Act 2002.

Hi Mr Gilliatt,

Thanks for your e mail.

If you have already complained to the IPCC about the conduct of the PCC then there is no need to lodge a complaint with the Police and Crime Panel. The PCP can not investigate complaints of a criminal nature against the Commissioner.

However, if the IPCC determines that the complaint is not of a criminal nature, then they will refer it to the Police and Crime Panel for consideration.
