HSMP JR extension (Economically Active & PEO Appointment)

UK Border Agency did not have the information requested.

Dear UK Border Agency,

I need interpretation/explanation on the Section 2 Point No. 12 of the FLR Tier1 (HSMP) Guidance notes (this form is used by applicant covered by HSMP Judicial Review document to extend their stay)

SECTION 2: Supporting Documentation
12) You must submit documents that demonstrate the following:
- your economic activity and your personal earnings to date if you are employed, during your stay under the Programme;
-evidence of the business you have established, if you are self-employed, such as a business plan and evidence that you have established a business bank account;
-if you are not economically active you will need to provide evidence to show that you have taken all reasonable steps to do so during your stay in the UK, e.g. several job applications relevant to your skills and experience.

Also in the FLR Tier 1 HMP form they have provided the fees for both postal applications and PEO services where as in the website

it says

Our public enquiry offices cannot consider your application if you are:

* a person who has been given discretionary leave to remain or humanitarian protection;
* a person with a poor immigration history;
* applying for permanent residence on the basis of 10 or 14 years' residence;
* applying for an extension of your visa on the highly skilled migrant programme;
* a business person, innovator, sole representative or investor;
* a seaman;
* a Gurkha; or
* an elderly dependant.
Unquote:

Kindly clarify the following points

1) What minimum salary will be considered as economically active?
2) Can Highly Skilled Migrants having HSMP visa apply through PEO services?
