HS2 works and safety of the public engaged in protests

Response to this request is long overdue. By law, under all circumstances, Health and Safety Executive should have responded by now (details). You can complain by requesting an internal review.

Dear Health and Safety Executive,

Please answer:

1) If and when does/has the HSE make/ made unannounced health and safety spot checks at High Speed 2 (HS2) Phase 1 works sites engaged in tunnelling and/or felling of trees/clearance of woodland

2) Which health and safety issues must HS2 contractors and/or their bailiffs e.g National Eviction Team (NET) and the police, as organisations, report to the HSE with reference to the safety of the public present at an HS2 site protesting and/or obstructing the works thereon, and which Legislation covers such obligation?

3) Which health and safety issues must persons working for the police or for HS2 contractors or for bailiffs (such as a senior officer in attendance or a Health and Safety Officer) report to the HSE with reference to the public present at an HS2 site protesting and/or obstructing the works thereon, and which Legislation covers such obligation? Please further explain the legal obligations on any such employee who fails to report a breach of Health and Safety at work.

4) How does the HSE get involved if and when a death or injury to a member of the public occurs at an HS2 site?

5) What guidance has the HSE given to HS2 contractors and/or their bailiffs or to the police with reference to the safety of any member/s of the public (a) in occupation of a tree scheduled for felling, or in the course of being felled, or (b) is attached to the said tree eg by rope/s, cable or ladder or fastening or (c) is situated beneath or close to the said tree. If no such advice has been given is there any proposal to give this, and when?
