HS2 Non-Department Public Bodies - Advertising & Lobbying

We're waiting for J Marriott to read a recent response and update the status.

Dear Cabinet Office,

The document RULES ON LOBBYING FOR NON-DEPARTMENTAL PUBLIC BODIES
appears to be quite clear with regard to NDPBs and the use of advertising and lobbying.

"Departments should ensure that these rules are reflected in individual bodies’ Framework Documents. It will be a requirement of the new NDPB review process that Departments assure compliance with these restrictions on a regular basis."

Please provide all the assurances that the Cabinet Office has received from the Department of Transport confirming compliance of HS2 Ltd with the restrictions outlined.

PR and Marketing
"- It should be exceptional for NDPBs to use PR or marketing consultants.
- Any requests to use PR or marketing consultants must be agreed by both
the sponsoring Department and the Cabinet Office.
- NDPBs must never employ external firms or consultants to influence or
attempt to influence Parliament, Government or political parties"

When did the Cabinet Office agree to allow HS2 Ltd to use PR and marketing consultants?

Please supply a copy of all such Agreements.

Please outline all cases where the Cabinet Office has taken action with regard to any breach of those Agreements.

The reponse I received referred to two letters from August and December 2018 whch were not attached. Apparently the December letter has not even been issued. I will follow up.

The gist seems to be that there has not been any HS2 PR and marketing.

Thank you for your response. Unfortunately it did not include either of the letters.
Can you explain why the December letter has not been formally issued? Were any drafts issued? if so when were they sent?

Can you provide copies of the requests from HS2 Ltd and DfT that generated these letters.

You have not responded to my question regarding any assurances that the Cabinet Office has received from DfT confirming that HS2 Ltd has complied with the restrictions outlined.
Have you ever received such assurances?

Can you please send me a copy of your assessment of the arguments used to invoke Section 35(1)(a) of the FOI Act as this request does not appear to relate to the formulation of policy or communications between ministers.

You refer to "funding" and "two campaigns". Can you please clarify exactly what these refer to if this is not explained in either of the letters or any other parts of your response?

Please respond by return as it has already taken 20 working days so far.

Your response also raises two further points which were not in my original request:-

Can you confirm when the Rules of Lobbying were first published?

Can you confirm whether any previous requests have been received from either HS2 Ltd or DfT for "communications activity" or any other form of communications associated with HS2 since the lobbying rules were introduced?
