HS2 - Latest Major Projects Authority Report

The request was refused by Cabinet Office.

Dear Cabinet Office,

I would like to know the latest traffic-light rating given to the HS2 project by the Major Projects Authority. I would also like a copy of this report, or at least to know the areas of concern and/or suggested actions which have been recommended.

I make this request under both the FOIA and the EIRs. I feel the need to point this out, as despite rulings from the Information Commissioner on cases FER0467548 and FER0536325 submitted by Dr Paul Thornton, which established that MPA reports on HS2 contain environmental information as defined in the EIRs, with my most recent request FOI320440 to you (which has now been ruled on by the ICO as FER0578594 as has the associated FER0570401 to HS2 Ltd) you failed to accept any obligation to comply with my request under the EIRs.

In that case, you also completed failed to provide the outcome of the internal review I request on 5th February (IR320440) to either myself of the ICO.

I sincerely hope you will accept the consistent rulings of the ICO, that MPA reports on HS2 are covered by the EIRs and reply accordingly, instead of employing the continual obfuscation I have come to expect when making these requests.

Dear Mr Smethhurst,

I find more than a coincidence that your holding reply of 3rd November was sent, just two and half hours after I mentioned this specific request in my response to the First Tier Tribunal regarding case EA/2015/0207.

I am surprised you feel that my request for an internal review on October 26th was invalid, as this was the 41st working day after my initial request was submitted on 27th August, in which time the Cabinet Office had completely failed to respond. As you should be aware, this was over twice the time allocated by law in which you should have responded. This failure to respond is consistent with your failure to respond to my previous request for an internal review in the case FOI320440 on 5th February.

Whilst I believe that my original request for an internal review was completely valid, please consider this as another request for one under Section 11 of EIR.

Dear FOI Team Mailbox,

Today you replied to the request for an internal review I made on 4th November (Your Ref IR321655).

I initially thought your reply, only 8 days beyond the required 20 days, was a significant improvement on my previous request for an internal review (Your Ref IR320440) of 5th February which you never replied to, beyond the standard holding response. However, on opening the email I realised that this was not a reply to my request for an internal review, as your response seems to have treated it as if it were a new request allocating it reference number FOI322177.

It is clear to me that you have got confused with this request and the new one I made on Friday 11th December, which is for the 2015 MPA (or now IPA) report on HS2 which should have conducted in or around November.

For clarity, the three outstanding requests I have made to the Cabinet Office for MPA reports on HS2 are for three different reports, the first two of which are awaiting internal review, the last one is awaiting the initial EIR response.

Having said all that, there is little point now in responding with an internal review with respect to the first request, as this is currently awaiting a hearing of of the First Tier Tribunal.
