Dear Mr Lock

Freedom of Information request – Ref 4901

I write further to your request for information about the HS2 compensation
consultation, which we received on 18 November 2013.

You asked for a copy of all correspondence (including by email) between
SMBC Councillors and Officers (Officer-officer, Councillor-Councillor,
Officer-Councillor) in relation to the OSMB and Cabinet decision to
support the recommendation of the SMBC HS2 Working Party on the matter of
the HS2 Compensation Consultation ending 4 December 2013.  For the
avoidance of doubt, this should cover relevant correspondence leading to
the Working Party's recommendations and subsequent correspondence for the
period between 1st September - 18th November 2013.

We can confirm that we do hold information about the consultation.
However we are not yet in a position to provide copies.  We have
identified emails about arranging the meeting but we need to read through
every email to see if they are actually about compensation and to assess
if any exemptions apply or not.  So unfortunately we are not able to
supply any information today.  We apologise for not being able to meet the
deadline because of this.  We hope the delay does not inconvenience you
too much.

Yours sincerely

Dear Mr Lock

Request for Information - Reference Number 4901

I write further to my previous email about your request for information about the HS2 compensation consultation correspondence on Tuesday 17 December.

We apologise for the delay in responding and are now in a position to be able to supply the information sought. You will notice that some of the documents have a small number of redactions. Any redactions have been made to obscure personal information belonging to third parties where disclosure would be likely to breach the fairness element of the first principle of the Data Protection Act 1998. For example, we have redacted personal e-mail addresses and names of members of the public and some junior staff because it would not be their expectation that this information would be made public. In so far that the redacted information falls under the scope of the Freedom of Information Act 2000 the Council is relying upon section 40(2) of the Act to withhold the information and in so far that it falls within the scope of the Environmental Information Regulations 2004 the Council is relying upon regulation 13 to withhold the personal information.

Due to the size of the files we are unable to send them all at once and will need to make several uploads.

I hope this information is of interest and assistance. You may copy, distribute, transmit, adapt or otherwise exploit any information disclosed to you providing that you do so in accordance with the conditions which can be found on the council’s website http://www.solihull.gov.uk/about/copyrig....

If however you are dissatisfied with the response you have received and wish to request a review of our decision or make a complaint about how your request has been handled you should write to the Corporate Information Governance Manager, Corporate Performance, Policy and Information, Business Transformation Directorate, Council House, Manor Walk, Solihull, West Midlands B91 3QB or email [Solihull Borough Council request email].

Your request for an internal review should be submitted to us within 40 days of receipt by you of this response. Any requests received after this time will be considered at the discretion of the Corporate Information Governance Manager.

If having exhausted the review process you are not content that your request or review has been dealt with correctly, you have a further right of appeal to the Information Commissioner's Office (ICO) for a decision. Generally, the ICO will not make a decision until you have exhausted the complaints procedure provided by the council. The Information Commissioner can be contacted at Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF, telephone: 01625 545 700, website: http://www.ico.gov.uk.

Should you have any further questions please do not hesitate to contact me.

Yours sincerely
