Section 40 Personal Information

 

Some of the information we are providing you has been redacted under
Section 40 of the FOIA as it is the personal information, this includes
SYFR staff names, partial email address, and mobile telephone numbers. 

 

Section 40(2) provides that personal data about third parties is exempt
information if one of the conditions set out in Section 40(3) is
satisfied.  Under the FOIA, disclosure of this information would breach
the fair processing principle contained in the General Data Protection
Regulations (GDPR), where it would be unfair to that person’s
confidentiality.  We have used the information Commissioners guidance
regarding third part data, see link:

We believe this personal information would not routinely be available in
the public domain and this would be the expectation of these individuals. 
Section 40 is an absolute exemption and there is no requirement to carry
out a public interest test.

 

If you are dissatisfied with the handling of your request, you have the

submitted within two months of the date of receipt of the response to your
