RE:     Freedom Of Information Act 2000 – INFORMATION Request

We have considered your request for information and on this occasion we
cannot supply the information you have requested. In accordance with
Section 17 of the Freedom of Information Act 2000 this letter acts as a
Refusal Notice.

In considering your request the Council believes that the absolute
exemption pursuant to Section 40 of the Act is applicable. This exemption
relates to third party requests for personal information and is decided in
accordance with the data protection principles.

Personal information can be defined as information that relates to or
identifies a living individual. This information can be held or recorded
in any form. The Data Protection Act provides a legal framework for how
data controllers, such as the Council, should process personal data.
Section 40 of the Act recognises that there are instances where personal
data should be excluded from entering the public domain.

In order to apply this exemption the data in question must constitute
personal data. The Council has considered this and drawn the conclusion
that this information relates to several individuals, it also clearly
identifies them.

In considering the S40 exemption the Council seeks to rely on subsection
3A of the Act. Section 40 (3A)(a) is that the disclosure of the
information to a member of the public otherwise than under this Act would
contravene any of the data protection principles.
