This request has been closed to new correspondence. Contact us if you think it should be reopened.

The request was successful.

Dear Information Commissioner’s Office,

Please kindly provide a list of all counts where you have had to fine the DWP for breaching
the terms of the Freedom of Information Act 2000 (such as section 77) since it was introduced.

We would like the list to contain dates and the fine amounts in Great British Pounds.

Much appreciated.

Yours faithfully,

Lee Jefferson
Journalist.

Information Commissioner's Office

10th November 2017

Case Reference Number IRQ0708177

Dear Lee Jefferson

Thank you for your correspondence of 30 October 2017 in which you
requested information from the Information Commissioner's Office. Your
request was handled in line with your rights under s 1 of the Freedom of
Information act (FOIA) and our response is below.

Request

"Please kindly provide a list of all counts where you have had to fine the
DWP for breaching the terms of the Freedom of Information Act 2000 (such
as section 77) since it was introduced.

We would like the list to contain dates and the fine amounts in Great
British Pounds."

Response

Firstly, it may be of assistance to clarify that we can only issue civil
monetary penalties (fines) for breaches of the Data Protection Act (DPA)
and also the Environmental Information Regulations (EIR) but not for FOIA
breaches. You can read our guidance on civil monetary penalties [1]here

We have the power to prosecute in relation to offences described in
section 77 of the FOIA. We have not prosecuted the DWP and for clarity we
have not prosecuted other individuals or public authorities in connection
with s 77 offences. You can read about our regulatory action policy under
FOIA [2]here

I hope you find our response of assistance.

Yours sincerely

Iman Elmehdawy
Information Access Service Manager
