Dear Elisa,

 

Thank you for your email of 6 November 2018 requesting information Under
the Freedom of Information Act (FOIA) 2000.  I set out below your request
together with our response:

 

1. How many DNR orders were overturned between the years 2007-2012 that
led to the attempted resuscitation of a patient (whether that was
successful or not)?

 

2. How many DNR orders were overturned between the years 2012-2017 that
led to the attempted resuscitation of a patient (whether that was
successful or not)?

Your request was considered under the Freedom of Information Act 2005. I
can confirm that the Trust holds the information requested, however, it is
exempt from disclosure under section 40(2) of the Act. I regret therefore,
that on this occasion your request has been refused under section 40 of
the Freedom of Information Act.

 

Section 40, of the Freedom of Information Act allows an organisation to
refuse requests where information is the personal information of another
and the release of the information breaches the Data Protection Act 2018.
In this instance accessing the information would result in a contravention
of several principles of the Data Protection Act. The information
requested is held in individual patient records use of which is limited to
direct patient care. You can find out more about section 40 from the
Information Commissioners Office website.

 

3., How does your Trust receive DNR Orders from patients?

 

DNR orders are established and documented into the electronic patient
records by clinicians in discussion with family as appropriate.

 

The information supplied to you continues to be protected by the
Copyright, Designs and

Patents Act 1988. You are free to use it for your own purposes, including
any non-commercial research that you are doing and for the purposes of
news reporting. Any other reuse, for example commercial publication, would
require the permission of the copyright

holder which must be expressly given.

 

If you are unhappy with this response the Trust has a formal Complaints
Procedure which you may use by writing to The Medical Director,
[Croydon Health Services NHS Trust request email].  If you remain unsatisfied you may contact the
