How many compromise agreements have been signed by teachers and Head teachers with a result of these members of staff losing or leaving their jobs since Sep 2004.

Under the FOI Act 2000, I would like to know how many teachers, and Head Teachers have:
1) Signed a compromise agreement since September 2004.
2) How many of these resulted in the termination of their employment with yourselves, the council.
3) How long they had been working for the Educational Service in your Council.
4) How old they were on their day of leaving.
I would be grateful if you could let me know if there is a cost to this request.

Firstly, please note that the City (the "Square Mile") has a resident
population of only around 8,000 and, probably uniquely for a Local
Education Authority (LEA), maintains only one school in its capacity as a
LEA, namely the Sir John Cass's Foundation Primary School, a voluntary

In light of there being only one LEA school within the City, with a
relatively small number of employees, we consider that, in accordance with
the FOIA section 40(2) exemption ('personal information'), the duty to
confirm or deny whether information is held in relation to your request
does not arise. The section 40(2) exemption is an absolute exemption.

Thank you for your response which I have now considered.
I appreciate your concern with only having one school, but I, as a member of the public has the right to know how often or not this occurs, as public money is involved in this management method. For the sake of public accountability and transparency, I believe that this is a legitimate request.
I have no knowledge of the school and am not interested in the detail.

As the City (the "Square Mile") is a small local authority, with only one
maintained school, requests which may not involve the release of personal
information in breach of the data protection principles in other public
authorities will engage the section 40(2) exemption here in the City.
Consideration of public interest factors, such as those you raise, will be
relevant in considering release of information relating to individuals
employed by a public authority. However, when responding to requests to
disclose information relating to a small authority area with only one
maintained school it will also be relevant to consider whether disclosure
could compromise an individual's privacy at any time and whether such
disclosure would be unwarranted and unfair. We have reconsidered your
request and consider the public interest considerations to be finely
balanced in the circumstances. However, it has been decided that we will
disclose the information that you originally requested and we can advise
that there have been no compromise agreements since September 2004 signed
by any teaching staff within the one school maintained by the CoL.
