I am writing to request an internal review of Hammersmith and Fulham Borough Council's handling of my FOI request 'Housing Shadow Board'.

Whereas the previous follow up was classed as an Internal Review, I understand that the Council may not have had a full opportunity to exhaust the internal review process as per the ICO's correspondence (ref FS50710650) below;

"From the details you have provided, it appears that you have not yet exhausted the public authority’s internal review procedure. Before accepting complaints, the Commissioner requires public authorities to be allowed the opportunity to respond to any complaints the requester may have about the way in which their request was dealt with. Whilst you did submit an internal review request, via whatdotheyknow.com, on 9 October 2017, this was before the Council had issued its formal response and therefore the only matter which it could have addressed at that point was the delay in responding and not the substance of the response itself - which appears to be what prompted your complaint to the ICO. You should, therefore, contact the public authority again, asking it to review its handling of your request."

My request for an internal review with the Council therefore seeks to challenge the way my FOI request was handled.

There is a Government requirement for sufficient information to be provided to residents and stakeholders throughout a housing stock transfer project, under the provisions of the DCLG’s Housing Transfer Manual.

The project involved proposals by the Council to dispose of £800M of public land and property into a private ownership vehicle, including the option of a housing association and mutual. The project incurred costs of nearly £2M to review the options, money that could have otherwise been re-invested in public services or seen council taxpayers’ rates reduced.

The Council has faced requests for this information to be made available from a number of different parties, see the Council website (www.lbhf.gov.uk), Housing Residents Forum papers, Councillor enquiries and other FOI requests.

Resident representatives raised their concerns originally on 28/03/2017 that the Council were not acting in a transparent manner with the Housing Stock Transfer proposals as shown in Minutes from the meetings on 28/03/2017 (see section 9.3) and 16/05/2017 (see section 3.3).

Councillors, tenants and leaseholders have raised their concerns at the Council’s lack of transparency on the now-closed Housing Stock Transfer project at numerous formal and informal meetings, including requests being made at the Council’s Housing Policy & Accountability Scrutiny Committee meetings.

Councillors are entitled to access to the documents as part of their role. Resident representatives have been able to view the documents at the Council’s offices. The documents are therefore already essentially in the public domain.

Meeting papers from the Shadow Board were consequently made available for viewing at the Council’s offices for members of the Housing Representatives Forum for four sessions in mid to late June. The Council have continued to resist requests for these documents to be supplied under FOI.

This is in contrast to the Residents’ Commission referred to in the Council’s refusal letter where it was recorded that the Residents’ Commission and Stock Options Appraisal project that preceded the Housing Stock Transfer project demonstrated best practice in the view of the independent tenants’ adviser, the Tenants Participation Advisory Service (TPAS), for publishing YouTube recordings of meetings, transcripts of hearings, and minutes of Residents’ Housing Commission meetings during the preceding phase of the Council’s now closed housing stock transfer project. The preceding project saw documents published on a dedicated project website and saw plaudits from TPAS for it demonstrating best practice for subject resident-focussed projects, as shown in their report.

Irrespective of whether there are arguments that may favour or disfavour the Council’s preferred outcome, it is important that residents and the community are given full or information from both perspectives to allow them to make up their own minds rather than being limited to only receiving the select information that the Council wish to promote. When this issue influences voting decisions by residents on £800M of their public property based on a feasibility project that has cost the community £2M, there are clearly public interest questions to be asked.

Therefore, the public interest test must fail to indicate any other than the documents should be published in full.

The Housing Shadow Board and project are both finished, it is a completed project. The Council seems to want to conflate the two separate projects seeking cover from releasing the information in this request.
The public interest test, therefore, does not apply as the Defend Council Homes project is a separate project that the Council have stated in the Housing Representatives Forum on 16/05/2017 that will not review the previous issues.

The previous internal review conducted by Hammersmith & Fulham did not take into account these public interest test issues and the way my request was handled. I, therefore, would like an internal review.
