Housing Development Companies

Response to this request is long overdue. By law, under all circumstances, City of York Council should have responded by now (details). You can complain by requesting an internal review.

Dear City of York Council,
It came as a surprise to many citizens that the Council’s apparent policy on forming a housing development company made last December was reversed so quickly in August. It was the subject of a Scrutiny calling in -

Multiple members from Labour, Lib Dem’s and Greens expressed concern at the paucity of papers on the matter published in the July Exec meeting.

The AD responsible Tracey Carter, during her presentation and in response to questions all on webcast, mentioned multiple times that they had ‘soft tested’ what other local authorities had done in terms of setting up development companies. These were used it appears to provide a range of options in terms of establishing such a vehicle.

Considering the record of CYC in setting up its own arms length businesses has been less than stellar ( Make it York, City of York Trading, Be Independent, Science City York) it is important that members and citizens are informed.

As the background papers are not available please provide the following
1. A schedule of all the development companies that staff looked into, by authority and type
2. All the recorded information on each of those dev companies
3. The legal case that appeared to be the reason why staffers changed their mind, and the recorded information
4. The legal advice provided, together with the firm that provided the legal advice and costs.
5. The total costs to date if this abortive work

Thank you for your correspondence about the way the Council is dealing
with your information request.  You are concerned that the Council has not
responded to your request within the statutory time scale.
 
On review, it appears that the Council has not provided you with a
response with the statutory time scale. I apologise for this.
 
I have now asked the service area to respond to your request as a matter
of priority within the next 20 working days.
 
The Council has a robust monitoring system in place to help ensure time
scales are met.  Council Officers also work hard to ensure the Council
meets statutory obligations.  Unfortunately, on occasions, meeting
timescales is not possible.  When this happens, late responses are logged,
reported on and feed into performance reviews, which allow us to take
steps, where necessary, to improve our processes.
 
Once again, I apologise for the delay.
