I would like to make a freedom of information request for the
following information;

- Total number of housing benefit claimants within the authority
for 'exempt' accommodation for the current year and the total for each of the 5 previous years (calendar or financial, however it is collated).

- Total amount of housing benefit paid by the authority for
'exempt' accommodation for the current year and the total for each of the 5 previous years (calendar or financial, however it is collated).

I am writing with regard to your request reference 876119, submitted under
the Freedom of Information Act 2000, with my apologies for our delayed

Response:

 

Under the Freedom of Information Act the Council has the right to refuse
to supply information to an applicant if an exemption applies. The Council
believes that an exemption applies in this case and has decided to refuse
your request.    The exemption under the Act, on which the authority are
relying is Section 12 of the Freedom of Information Act, the reason being
that the cost of complying would exceed the appropriate limit as we would
have to write reports for each of the years requested and analyse the data
before being able to send, which we estimate would take longer than the 18
hour limit.

 

If you are dissatisfied with our response, please write to the Information
Governance Senior Assistant, Luton Borough Council, Town Hall, Luton, LU1
2BQ to arrange investigation. If you remain dissatisfied after the
conclusion of the Council’s internal complaints procedure you may apply to
the Information Commissioner, Wycliffe House, Water Lane, Wilmslow SK9
5AF.
