Housing Appeals Process

The request was successful.

Dear Castle Point Borough Council,

Can you please advise of any appeal processes currently used with the Housing department?

If there are no appeal processes can you please advise how a resident is able to appeal against a decision made by the department.

Yours faithfully,

Claire Buckley

Dear Miss Buckley,

Please find relevant extract from the councils Housing Services
Allocations Policy which is available to view on the councils website.

The below outlines the appeals process.

4.27 Reviews and appeals

4.27.1 Housing applicants have a right to ask for a review of decisions
made about housing applications and offers of accommodation. This
includes:

4.27.2 Refusal of admission to the housing register.

4.27.3 Removal of a housing application from the housing register

4.27.4 Housing needs assessment, priority assessment and banding

4.27.5 Suitability of offers of accommodation

4.27.6 Requests for reviews can be made in writing or verbally and
submitted to the Council’s Housing Options Manager.

4.27.7 All reviews will be undertaken by a senior officer of the Council
who was not involved with the original decision.

4.27.8 The Council will complete a review as soon as practically possible
and within 56 calendar days of receiving a request.

4.27.9 On conclusion of a review, the Council will reply in writing and
will give the reasons for changing or upholding the original decision.

4.27.10 If the housing applicant is dissatisfied with the outcome of the
review, they can make a complaint through the Council’s Housing Service
complaints procedures, Local Government Ombudsman or seek to challenge the
decision via a judicial review in the court on points of law.

I trust this clarifies your enquiry.

Many Thanks

Rebecca Hewitt
