Freedom of Information Request – FOI2022/00825
We are writing in response to your email received by Post Office Limited (“
Post Office”)
on 17 December, which has been dealt with under the terms of the Freedom of
Information Act 2000 (“
FOIA”) in which you requested the following information shown in
bold below:
“
The Fujitsu Statement submitted to the Post Office Horizon Public Inquiry refers to
Horizon’s Third Supplemental Agreement of 19 January 2000 which was agreed
between POCL and ICL Pathway. I would be most grateful if you would disclose this
document.”
We can confirm that Post Office does hold the information you have requested. Some of
the information in the agreement has been redacted as Post Office considers it to be
personal data and therefore exempt under s40 of FOIA.
Section 40(2) & (3) – Personal Data
These sections provide that any information to which a request for information relates is
exempt information if it constitutes personal data and the disclosure of that personal data
to a member of the public otherwise than under the FOIA would contravene any of the
data protection principles set out in Article 5(1) of the UK General Data Protection
Regulation ("GDPR") (section 40(7) FOIA). Post Office is therefore withholding such
personal data in circumstances where such disclosure to you would contravene the
'lawfulness, fairness and transparency' principle set out at Article 5(1)(a) of the GDPR.
Post Office considers that it has no lawful basis on which to disclose to you that personal
data since none of the lawful bases listed under Article 6(1) of the GDPR are available to
it.
