Horizon based Prosecutions by POL

john o'sullivan made this Freedom of Information request to Department for Business, Energy and Industrial Strategy Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

Response to this request is long overdue. By law, under all circumstances, Department for Business, Energy and Industrial Strategy should have responded by now (details). You can complain by requesting an internal review.

Dear Department for Business, Energy and Industrial Strategy,In Dec 2009 Pat McFadden wrote to Lord Arbuthnot stating the department view that Horizon is robust and Post Office prosecutions are a matter for them to oversee. When did the department first become aware of the number of SPM that were being prosecuted by POL and when did they decide it wasnt a matter to be left to Post Office to supervise?

Yours faithfully,

john o'sullivan

Dear FOI Requests,Thank you for a reply. From 1st day Briefs supplied to Jo Swinson in 2012 and others up to 2016 Post Office Prosecutions and Horizon issues were not considered important. It is only since the CIT ruling by Justice Fraser and convictions being overturned in 2020 that 1st day Minister Briefings start with Horizon problems. Will refining your search to after 2019 reduce cost and find a specific meeting or strategy document that confirms BEIS awareness of the scale of the problem. In Feb 2020 Computer Weekly ran a story stating BEIS had been too passive in managing Post Office.

Yours sincerely,

john o'sullivan

Dear Department for Business, Energy and Industrial Strategy,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Business, Energy and Industrial Strategy's handling of my FOI request 'Horizon based Prosecutions by POL'.

[ GIVE DETAILS ABOUT YOUR COMPLAINT HERE ]By simply publishing all 1st Day Ministerial Briefs from 2000 we will see just when Horizon and Post Office prosecutions became a hot topic and why for many years it wasnt. If Ministers were not told who decided not to tell them?

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/h...

Dear FOI Requests,Thank you for a reply. In 2020 you knew of @900 Prosecutions and in 2013 none by POL.Can you say for each of these events if as share holder they prompted you to challenge POL about SPM prosecutions.1)Second Sight being sacked by POL 2)BBC Panorama program August 2015 3)Discussions with POL prior to Bates and others v POL 2017 4)Recusal attempt of Justice Fraser 2019 in terrorem 5)Your having a permanent seat on the Board? If none of these did can you provide details of what assurances POL supplied that gave you no cause for concern-perhaps proof of Horizon robustness, inherent criminality of SPM's etc?

Yours sincerely,

Dear FOI Requests,Thank you for a reply.I read this in the commons library"The Post Office is a limited company owned entirely by the government. The
Department of Business Energy and Industrial Strategy holds government
responsibility for postal affairs, including the Post Office."CBP-7550.pdf.The Ministry of Justice and the Attorney Generals Office had this to say concerning Prosecutions of SPM" Policy matters concerning the Post
Office Limited (POL) cases is being led by the Department for Business, Energy and
Industrial Strategy (BEIS)".Are you saying that because you dont have a seat on the Board you do not have as much insight or knowledge as UKGI?How and by whom are you kept informed of Post Office actions? Is the document in the library,AG and MOJ wrong?

Yours sincerely,

john o'sullivan
