Dear Stratford on Avon District Council,

Can you please provide me with the following stored information under the Freedom of Information Act 2000.

1) A complete process tree / process map which you store, outlining the processes for homeless assistance
(such an example, is the FOI Guidance as outlined here:
https://www.whatdotheyknow.com/request/2... )

2) Guidance specifically issued to case workers within your department to determine what help an homeless applicant may require

3) Guidance which determines what kind of debts may mean a family cannot have assistance.

4) Any guidance issued to management in respect of homeless applicants

5) Any guidance in regards to homeless assistance when it comes to EEA Nationals.

6) Any guidance that you might store which outlines the rights of EEA Nationals and Their Family Members which are NON EU nationals to be named on Housing Tenancies.

As stated above: I would expect that this request is dealt with under the FOI Act.

Following my previous request to the Housing Advice Team, I am unsure whether the team are aware of the requirements of the act. Should you require assistance with this request then I am most certain that the Information Commissioner will be able to help you.

Answer: We do not have a document such as you describe. When dealing with homeless households the District Council does so by complying with the following legislation which outlines a local housing authorities lawful response to a homeless application (weblinks below):

2) Guidance specifically issued to case workers within your department to determine what help an homeless applicant may require

Answer: As above.

3) Guidance which determines what kind of debts may mean a family cannot have assistance.

Answer: Debts are not taken into account when determining eligibility for housing assistance under homelessness legislation. However, housing related debts may impact on how an applicant's housing register application is dealt with (eg reduced band in cases where debts are over a certain level). This is line with the published Home Choice Plus Allocations Policy which can be viewed here: www.homechoiceplus.org.uk/NovaWeb/Infras...

It is also possible that a housing association landlord in the District may decide not to offer a tenancy unless outstanding debts are cleared, or brought down to a satisfactory level, or where a regular pattern of repayments can be demonstrated. This will be down to individual housing associations allocations policies:

Answer: As above, the Council treats homeless households in accordance with homelessness legislation and the code of guidance.

5) Any guidance in regards to homeless assistance when it comes to EEA Nationals.

Answer: As above, the Council treats homeless households in accordance with homelessness legislation and the code of guidance.

6) Any guidance that you might store which outlines the rights of EEA Nationals and Their Family Members which are NON EU nationals to be named on Housing Tenancies.

Answer: Households are treated according to legislation in respect of who is and who is not entitled to a housing allocation, in line with the Home Choice Plus Allocations Policy.

As stated above: I would expect that this request is dealt with under the FOI Act.

I am writing to request an internal review of Stratford on Avon District Council's handling of my FOI request 'Homeless Assistance Processes'.

Please can you provide me with a copy of information you store which outlines the elegibility of a person who's status in the UK stands as "Family Member of an EEA National" within the meaning of the Immigration (European Economic Area) Regulations 2006 to receive housing assistance.

Please note I am only interested in family members of EEA Nationals who hold the status of "Worker" / "Self Employed" and not "Self Sufficient" or "Job Seeker".

Please provide the following information:
* Elegibility to apply for housing in their own right.
* Elegibility to be named on tenancy agreements
* Elegibility to receive homeless assistance

I note that this information *would* be held by SDC. If Sarah Jane / Suzanne / Jane / Richard / ETC refer to the PDF document you refered me to previously, then this is still considered stored information (even if produced by a seperate Public Authority).

I am well aware that your department have issued a number of letters to housing applicants using the term "Subject to Immigration Control" when refering to persons who are resident in the UK under a provision of EC Law. These letters, I am sure, would be letter templates - and therefore stored information.
