Home Office Communications Data

Michael Tandy made this Freedom of Information request to Home Office This request has been closed to new correspondence. Contact us if you think it should be reopened.

The request was refused by Home Office.

Dear Home Office,

As you may be aware, disclosing communications data is vital to tackle crime and protect the public from the most serious of crimes, including child abuse, murder, rape, and kidnapping.

For all e-mails, website visits, teleconferences and telephone calls performed from the home office's computers and telephones in the last 6 months, I request the time and duration of the communication, whom the communications are between, and the locations of the devices from which the communication was made.

I would like this information delivered electronically, in comma-separated value ('CSV') format, one line per communication event.

In the event any of this data is not currently retained, I request an estimate of the cost of retaining it for all future communications; and as much data as is available.

In the event the cost of complying with this request exceeds the FOIA S.12(1) limit, I request the number of communication events of each type other the last 6 months; an estimate of the total cost of reporting on the full 6 months; and as much of the data as can be provided within the limit, starting with the most recent communication events.

Yours faithfully,

Michael Tandy

Dear FOI Requests,

Section 8(1)(c) of the FOIA only requires that the request for information "describes the information requested" - my request clearly describes the information requested.

I did not request an entire class of data; I requested only a subset of the class of communication data. You will note I did not request the content of messages, only the times and recipients; and neither did I ask for written, postal, bike messenger, spoken, radio, fax, SMS or two-way pager communication, nor any form of magic, telepathic or other communication.

I will admit that my request is broad, but I can see nothing in the act that prohibits broad requests. This request should be simple and inexpensive for you to fulfil, as you are already retaining the data requested.

I would remind you that communication data is vital for the investigation of all forms of serious crime, including terrorism and child abuse. If you have nothing to hide, you have nothing to fear from releasing this information.

I look forward to receiving the information.

Yours sincerely,

Michael Tandy
