Dear Carla,

I apologise for the delay in responding to your request, the reason being
that the question you have asked us is one which we are reluctant to
answer for fear that the information reaches the public domain and places
kennel staff and property at risk. I have therefore consulted with our
legal colleagues before responding. I have copied your request below for
ease of reference and the answers are within the text in italics;

 

Dear Woking Borough Council,

 

Please can you answer the following:-

 

1, The name/s and address/es of the establishment/s to which dogs are
taken when found to be straying in your area.

 

We obviously hold the information relating to the name/s and address/es to
which dogs are taken when found to be straying in our area. However, this
will not be provided to you as it is subject to the exemption in Section
38 of the Freedom of Information Act 2000. Section 38 provides that
information is exempt from disclosure if its disclosure would, or would be
likely to, endanger the safety of any individual. We consider that making
public details of the kennel(s) to which stray dogs are taken may result
in members of the public going direct to the kennel(s) to try and claim
back their dog. This is likely to prove a risk to the safety of the kennel
staff due to the potential arguments or risk of violence that could
entail.

The exemption contained in Section 38 is subject to the “public interest”
test, i.e. we must decide whether the public interest in maintaining the
exemption outweighs the public interest in disclosing the information. We
are satisfied that the “public interest” test is satisfied in this case.
This is because the risk to the safety of the kennel staff must be given
greater weight than making known the names and addresses of the kennel(s)
concerned.

 

2, How often are the holding kennels inspected by the council?

 

The holding kennels are situated outside of the Borough and therefore we
do not inspect them on a regular basis for licensing purposes. On starting
the new contract with out of hours stray dog collectors in April of this
year, myself, a Senior EHO and the Animal Warden for the Council visited
the kennels to ensure they met with our expectations / tender
specifications.
