HMRC stood to lose prior to s.58 FA2008

The request was refused by HM Treasury.

I would like to request any information which confirms the view that if HMRC had taken litigation, prior to s.58 FA2008, the courts would more than likely have ruled in favour of the users of the scheme (ie. HMRC stood to lose).
