I have to question the "reasonably available" point as the source is buried outwith HMRC's website.

Thank you for your email dated 30 June 2014 requesting an internal review
of the way that we dealt with your FOI request.

 

Your request

On 10 April 2014, you asked for the following information in relation to
the buildings HMRC occupies under the PFI contract.

 

“1) Which buildings etc used by HMRC are funded under the Private Finance
Initiative?

2) What has been the cost to HMRC of leasing each of the PFI properties
etc identified at 1 above”

 

Our response

Under section 21 of the FOIA, we are not required to provide information
in response to a request if it is already reasonably accessible to you.
The information you have requested is included in the Central Government
Property and Land dataset published by the Cabinet Office as part of the
Government’s transparency agenda and can be found at the following link:
[1]http://data.gov.uk/dataset/epims. The “Property Data” and “Building
Data” files contain the requested information.

 

Internal Review

You emailed on 30 June 2014 seeking a review of the decision stating:

incurred by HMRC?”

 

I have been asked to review your request and its handling. The purpose of
the internal review is to provide a fair and thorough review of decisions
made under the FOIA.

 

Your request was dated 10 April 2014 and I can see that our response was
issued on 14 April 2014, within the statutory time limit required by
Section 10(1) of the FOIA.

 

Our response also included information about your right to request a
review and to complain to the Information Commissioner in accordance with
Section 17(7) of the FOIA.   

 

My responses to the specific points raised in your request for a review
are set out below.

 

1. Although the data is not held on the HMRC website, it is published into
the public domain via the data.gov website along with numerous other
datasets from various government departments to form a central point of
reference.

 

2. As mentioned above, the data is not held on the HMRC website, there is
no requirement for HMRC to provide a direct link to the data.gov website
as this is readily accessible through internet search engines or via the
link we provided on our initial response.

 

3. It has been noted that the latest Building Data (dated Feb 28th 2014)
data file is corrupt with data missing in some fields. This problem has
been flagged to the relevant parties and it is hoped that the error will
be rectified when the new dataset is published. In the meantime the
Building Data file dated 17th October 2013 shows the costs incurred by
HMRC.

 

Conclusion

I have taken into account your views but do not feel that the data is '
not reasonably available' as it is with the public domain on a government
website. I do however acknowledge the latest version of the building data
does not identify the costs incurred by HMRC. This has been highlighted to
the data team and will be rectified in due course.

This completes the review process in HMRC. If you are not content with the
