Thank you for your response. I note that you have not detailed any actions by HMRC prior to 2010.
Can you give me evidence of the activities HMRC undertook to notify taxpayers before December 2010 (other than open enquiries on some but not all affected taxpayers) to raise awareness of their views on so-called Disguised Remuneration (DR) schemes (and those arrangements which HMRC believe will be caught by the 2019 Loan Charge)?
Some points for clarification:
I am aware HMRC opened enquiries on the arrangements (that HMRC believe will be captured by the 2019 Loan Charge) of some taxpayers before December 2010.
Many other taxpayers who used arrangements before December 2010 (that HMRC believe will be captured by the 2019 Loan Charge) do not have enquiries on their arrangements.
I am specifically looking for evidence that HMRC undertook actions, prior to the DR legislation being introduced in December 2010, to inform those without an enquiry that HMRC believed the arrangements did not work.
I am already aware that HMRC do not enact legislation.
