HMO register July 2019 under prescribed information

Waiting for an internal review by Tendring District Council of their handling of this request.

Dear Tendring District Council,

I searched on your website and couldn't find a copy as prescribed under the Housing Act 2004 s.232 (1) and the information that is required to be maintained within the register is described in the The Licensing and Management of Houses in Multiple occupation and Other Houses (Miscellaneous Provisions) (England) Regulations 2006.

The latter is extracted here for convenience:

Registers of Licences

11.—(1) The following particulars are prescribed for each entry in a register established and maintained under section 232(1)(a) of the Actin respect of a licence granted under Part 2 (HMOs) or 3 (selective licensing) of the Act which is in force—

(a) HMO Property Address
(b) HMO Licence Holder(s) Full Name
(c) HMO Licence Holders Correspondence Address
(d) HMO Managers Name
(e) HMO Managers Address
(f) A short description of the licensed HMO or house;
(g) A summary of the conditions of the licence;
(h) Date of Licence Commencement
(I) Date of Licence Expiry
(j) Duration of Licence
(k) Licence Number
(l) Number of Households
(m) Maximum Number of Occupants
(n) Number of Units/Bedrooms
(o) Number of Self Contained Units
(p) Number of Non Self Contained Units
(q) Number of Storeys
(r) Number of Kitchens
(s) Number of Reception
(t) Number of Bathrooms
(u) Number of Separate WCs

A reply using Excel format would be very helpful.

TDC have chosen not to make the full register available on our website
electronically as we do not feel personal details should be in the public
domain.

 

We do hold a register as required by section 232 (4) of The Housing Act
2004 and it contains all the information listed under The Licensing and
Management of Houses in Multiple Occupation and Other Houses
(Miscellaneous Provisions) (England) Regulations 2006.

 

Under section232 (4) there is a requirement for the register to be made
available at the Local Authority's head office which it is – 88-90 Pier
Ave, Clacton-on-Sea, Essex, CO15 1TN. The aforementioned legislation does
not require a Local Authority to publish an electronic version. However,
we do have an electronic version of all licensable HMO’s on our website
minus personal details.

 

Therefore, if you still require access to the HMO Register of Licensable
properties, you will need to make an appointment with Tendring District
Council by calling Grant Fenton-Jones on 01255 686783 to come and view the
hard copy held at the above offices at a time convenient to us.

 

I hope this information is of assistance to you. However if you feel that
the Council have failed to deal with your request for information
correctly you can request that the matter is reviewed in accordance with
the Authority's Complaints Procedure. Requests for internal reviews should
