Dear Kizzy Jugon,

Ref: FREEDOM OF INFORMATION ACT REQUEST FOI2021/00127

Thank you for your request for information received on 4th November.

Your request is being considered and will be processed by 3rd December
within the statutory timescale of 20 working days as required by the
Freedom of Information Act 2000. On occasion we may need to extend this
deadline; we will inform you if this is likely.

There may be some instances where we need to contact you in order to
clarify your request to ensure we provide you with the information you
require. If that is the case we will not be able to process your request
further until clarification has been received.

For your information, the Act defines a number of exemptions that may
prevent release of some, or all, of the information you have requested.
You will be informed if this is the case and given details of your right
to appeal.

If the information you requested contains reference to a third party then
they may need to be consulted prior to a decision being taken on whether
or not to release the information to you.

In some cases, there may be a fee payable for this information to cover
disbursement costs. This will be considered and you will be informed if a
fee is payable.

Herefordshire Council publishes a great deal of information already on the
[1]council's website, particularly the [2]Publication Scheme, [3]Open data
and [4]Understanding Herefordshire, and you may be able to find the
information you require by checking there. If you subsequently find the
information you require by this method and no longer wish us to process
your request, please do let us know.

Our webpages also set out how we [5]process your data when you make a
request for information.

Further guidance on the Freedom of Information Act 2000 is also available
from the [6]Information Commissioner's Office.

If you have any queries or concerns regarding this please let me know.

Yours sincerely

Dear Kizzy Jugon,

Ref: FREEDOM OF INFORMATION ACT REQUEST FOI2021/00127

Further to our previous correspondence, your request has now been
considered and the council's response is set out below:

Please can you provide me with the following information under the Freedom
Of Information Act:-

a) addresses of all Registered Residential HMO properties that are within
your councils area;

b) the maximum number of occupants that each property referred to in (a)
is licensed to hold

c) the last actual registered number of occupants that each property
referred to in (a) holds

d) the date each of the properties in (a) was first registered as HMO

e) the names of the owners/licence holders of those properties referred to
in (a) and the correspondence address OR the registered "licence holder
address" of the owners referred to

Please share all the above in a PDF, CSV, or excel format.

We have considered the legitimate interest in members of the public
accessing the data as part of the public register without having to travel
to inspect it, and through the information we provide in our application
form the individuals concerned are aware that the register will be made
available. Please therefore find attached a spreadsheet containing the
information requested.

Please note, however, under the General Data Protection Regulations
individuals have to specifically opt in to receive marketing
correspondence. The disclosure of licence holders' addresses on the public
register does not constitute the consent of those licence holders to be
contacted for marketing purposes.

The maximum number of occupants that each property listed is licensed to
hold can be found in column AX.

Please note that we do not record the actual number of occupants at a
property unless they exceed the permitted.

For any queries about re-use please see [1]re-use of council data.

If you are dissatisfied with the council's handling of your request, you
can ask us to review our response. Requests for review should be submitted
within 40 days of receipt of this letter. Further details can be found in
the [2]Internal review procedure for FOI and EIR requests. Please quote
the above reference number in any correspondence.

Further information is also available from the Information Commissioner's
Office who can be contacted as follows:

Information Commissioner's Office

Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF

Telephone: 0303 123 1113 Website: [3]ICO

Please note that we already publish a variety of information on the
[4]council's website, and in particular in our [5]Publication Scheme,
[6]Open Data and [7]Understanding Herefordshire, which you may find of use
if you are looking for information in the future.

Yours sincerely
