Dear Wandsworth Borough Council,
Please can you provide me with the following information under the
Freedom Of Information Act :-
a) addresses of all Registered Residential HMO properties that are
within your councils area for:
i) Mandatory licences
ii) Selective licences
iii) Additional licences
b) the maximum number of occupants that each property referred to
in (a plus subsections) is licensed to hold
c) the last actual registered number of occupants that each
property referred to in (a plus subsections) holds
d) the date each of the properties in (a plus subsections) was first registered as
HMO
e) the dates of the properties in (a plus subsections) expires
f) the names of the owners/licence holders of those properties
referred to in (a and subsections) and the correspondence address OR the registered
"licence holder address" of the owners referred to

I refer to your request for information received on 29/10/2018. Please
see the information below in response to your request: -
Please can you provide me with the following information under the Freedom

Please note that the information you have requested under a) b) d) and e)
is available on Wandsworth Council’s website [1]here . These are all
mandatory licences. The Council does not hold up to date data on the
number of occupiers.
Names and addresses of HMO owners are available from HM Land Registry.
You would need to set up an account at HM Land Registry and pay the
required fee for each property you search for.
The names and addresses of HMO licence holders are available on request
under the Housing Act 2004 section 232, which states that every local
housing authority must maintain a register of licences for houses in
multiple occupation (HMO). The register must contain prescribed
particulars (which, by virtue of SIs 2006 No.373 and 2007 No.1903, include
the name and address of the licence holder), it must be made available for
inspection and a copy of the register (or an extract) must be supplied,
subject to payment of a fee, on request.
Therefore, the information you have requested is technically exempt from
disclosure under FOI, due to our obligations under section 232 of the
Housing Act 2004. ICO guidance is that the Council should treat all
requesters equally and the Council should only disclose information under
FOI if the Council would disclose it to anyone else who asked, therefore
release of information under FOI should be considered as if it were being
released to someone who requested a copy of the HMO Register and paid the
required fee.
The Council would therefore advise you to email
[2][email address] to arrange a viewing of the register
or to request certified copies of the register as per your right to do so
under the Housing Act 2004. The required fee for a copy of the register
is £48.00, although there is no charge made to see the register, providing
no attempt is made to copy it.
As Wandsworth Council is refusing to disclose some of the information
requested under section 21 of the FOI Act, please accept this email as a
refusal notice issued under section 17 of the FOI Act.
