The Commissioner’s decision is that the Home Office was not entitled to
NCND holding any information. The Commissioner requires the Home
Office to take the following steps to ensure compliance with the
legislation:
• issue a fresh response confirming whether or not any information is
held. If it is held, it should either be disclosed or the Home Office
should issue a refusal notice in compliance with section 17 of FOIA
