I am writing regarding your request for information which we received 5
May 2023.

In that request, you asked us for the following information:

 

I would like to request data, at either yearly or monthly frequency,
whichever is available, dating to 1990, on :

3) Estimated number of potholes on UK roads not repaired after 2 weeks

We are dealing with your request under the provisions of the Freedom of
Information Act 2000.

Unfortunately, your request is unclear and I will be unable to proceed
with your request without clarification of the specific information you
wish to receive.

To help us locate and identify this, please could you tell us if you would
like information before 1990 and if so from which date or do you require
information from 1990 to present?

Please note we only manage the strategic road network in England,
comprising of motorways and some A roads. A map of our network can be
found [1]here. The strategic network covers over 4,500 and to provide
information for the whole of the network it may exceed the cost limit and
may be refused, if you have a specific location of interest, please could
you let us know. 

Please note that if I do not receive appropriate clarification of your
information requirements within two months from the date of this letter,
then I will consider your request closed.

Thank you for your information request dated 8 May 2023 regarding
Historical data of potholes on UK roads. We have dealt with your request
under the provisions of the Freedom of Information Act 2000.

You asked -

 

I would like to request data, at either yearly or monthly frequency,
whichever is available, dating to 1990, on :

I can confirm that we hold some of the information you have requested.

Information provided

1) The estimated number of potholes on UK roads

We don’t have the information to go back to 1990. The following figures
include all defects to paved areas, not just potholes.

2022 / 23 – 20716

2021 / 22 – 18903

2020 / 21 – 19088

I can confirm that under [1]section 1(1)(a) of the Freedom of Information
Act 2000, National highways does not hold the Information that you
requested. 

 

Advice and Assistance

Some parts of the strategic road network will require more maintenance
than others to ensure they remain safe and serviceable. All our roads are
regularly surveyed to determine repair priorities.

Our policy is that safety-critical potholes are repaired within 24 hours
of identification. This is followed up with a permanent repair within 28
days. Defects relating to asphalt or concrete carriageways are repaired in
accordance with MCHW specifications and DMRB design documents.

 

If you are not satisfied with our response you may ask for an internal
review within 40 working days of receiving the response, by replying to

Response: Internal Review in relation to request FOI/5511
 
 
Further to your e-mail, which was received on 7 June 2023 I have been
asked to undertake a review of the response to your request for
information under the Freedom of Information Act 2000. (FOI/5511).
 
You were dissatisfied with the response to your request because National
Highways response provided the information it did hold but also set out
that it did not hold other information requested, and so you asked 'can
you determine where the data I requested is held?'
 
 
How I have reviewed your request:
 
I have now had the opportunity to review your request and the response,
and I am content that the response provided to your request is compliant
with the Freedom of Information Act 2000.
 
With regards to your question about where else the information requested
could be held, as was set out in our request for clarification which was
sent to you on the 5 May 2023, National Highways is only responsible for
the Strategic Road Network in England and does not cover the minor roads
in England or the other major roads which are located in the other
countries that make up the United Kingdom. To obtain the information for
these roads, you would need to contact each of the individual local
authorities for the roads they cover, for example Shropshire County
Council, East Cheshire County Council, Hampshire County Council and so on,
and for the major you would need to contact the relevant
devolved government which would be the Welsh, Scottish and Northern Irish
Governments.
 
It is also worth indicating that questions 2-5 are quite subjective in
nature, where the term disrepair could have many different meanings and
road condition is unlikely to recorded in that manner within any
authority. Additionally, the Freedom of Information legislation only deals
in physically held information so using the term estimated is also likely
to continue in 'information not held responses' as an estimate in this
context would not be recorded or held. In any event, with regards to
National Highways, even if you remove the word estimated from questions
2-4 the information is not held on the basis that we do not record this
information in the format requested, this maybe different in other
authorities however.
 
Finally, the Department for Transport which is the central British
government department that covers roads, and other transport
infrastructure, for the whole of the UK may also hold some of the
information requested and therefore, if you haven't already done so, you
may wish to contact them with your request. 
 
Conclusion
 
In conclusion, I can confirm that the response National Highways provided
in regards to your request was compliant with the Freedom of Information
Act 2000 by providing the information it held and setting out that it did
not hold the other information. As such, I find that there is no further
action for National Highways regarding you request.
 
If you remain unhappy with the outcome of this internal review, you are
entitled to refer your complaint to the Information Commissioner's Office
(ICO) for a decision.
