Dear Crown Prosecution Service,

Under the terms of the Freedom of Information Act 2000, I hereby submit the following request for information held by the CPS:

A:

For each of the following time periods:

1) 1st April 1955 to 31st March 1965,
2) 1st April 1965 to 31st March 1975,
3) 1st April 1975 to 31st March 1985,
4) 1st April 1985 to 31st March 1996,

or, in the event that a search of this scope would exceed the statutory 18man/hours exemption, then (for the purpose of economy of the public purse), each of the following alternative time periods:

1) 1st April 1965 to 31st March 1975,
2) 1st April 1975 to 31st March 1985,

how many Police Reports were submitted to the CPS in respect of intended prosecution of former Councillor, Mayor and Alderman Peter JACONELLI, of Scarborough North Yorkshire?

B:

In respect of the foregoing CPS Reports, please provide the date of any ensuing court action (even in the event that certain cases were ultimately withdrawn following a withdrawal of the complaint) together with the respective name(s), ranks(s), collar number(s) and Constabulary of each respective Arresting/Reporting Officer.

For reasons of public interest, I respectfully beg that you address this Freedom of Information request as expeditiously as possible.

Thank you for your response.

On a point of clarification;

regarding your statement:

"Our records show that a case file relating to Alderman Peter Jaconelli, charged with indecent assault, was sent to the DPP’s Office in 1972. The records do not show whether a prosecution was authorised or whether the charge was subsequently dropped."

I note that you do not make clear from which Police Force and/or individual Arresting/Reporting Police Officer and Police Station the case file relating to Peter JACONELLI emanated, nor on what precise date the report was received. This information is crucial to my investigation.

Could I ask you to revisit your response so as to include that information, please?

It would be most helpful if you could provide this clarification as quickly as possible, since you clearly have the information to hand.

Dear Mr Ward,

 

I refer to our formal response to your request under the Freedom of
Information Act, dated 14 September 2015 , under reference: 5569. The CPS
has carried out some further investigation outside of our obligations of
the Freedom of Information Act 2000 and these findings have brought to
light an inaccuracy within our original response, for which I apologise.

 

Our initial response stated the following:

 

The timeframes you refer to fall before the formation of the Crown
Prosecution Service in 1986 pursuant to The Prosecution of Offences Act
1985.

 

CPS does however hold limited information regarding a record of cases
received by the former DPP’s Office.  This was transferred to the CPS upon
formation in 1986. Our records show that a case file relating to Alderman
Peter Jaconelli, charged with indecent assault, was sent to the DPP’s
Office in 1972. The records do not show whether a prosecution was
authorised or whether the charge was subsequently dropped.

 

The CPS is now in a position to confirm that a decision was taken as a
result of this file being sent to the DPP’s office in 1972.   It is
important to note from the record held that the DPP’s office ‘advised no
action’ on 10/10/72. This would suggest that Peter Jaconelli was not
charged.

Dear Freedom of Information Unit,

Further to the press release by Assistant Chief Constable Paul KENNEDY of the North Yorkshire Police on Friday 23rd October 2015, it is clear that further information directly related to my Freedom of Information request has come to light.

In particular, coverage in the Yorkshire Post ( http://www.yorkshirepost.co.uk/news/main... ) suggests that the victim was a young Spanish man:

"Jaconelli, who would be facing allegations of child sex abuse if he was still alive, was alleged to have indecently assaulted a Spanish man more than four decades ago, according to North Yorkshire Police."

I hope that you will be able to confirm that the reason that the DPP’s office ‘advised no action’ on 10/10/72 was that the complainant was no longer available to testify. It may be that, if such is the case, I could assist the North Yorkshire Police.

In the public interest, and in the interests of tranparency, could I ask you, please, to provide as much information to me as possible?
