Dear Marine Management Organisation,

The Court case ref 2100358279: MMO versus WBC apparently took place on 21st March after it had been adjourned 4 times before.
Can you please let me know the outcome :
1. Did WBC plead guilty re negligence and not asking MMO for permission prior to carrying out the work?
2. If yes : What was the sentence /fine?
3. Are there personal consequences for those staff at WBC or Northwest construction responsible for the environmental disaster?

Dear Ms Kuhlmann-Müller,


Thank you for your email below. In response to the questions you have
asked, I can confirm the following:


1. Wirral Borough Council entered a guilty plea to a single offence of
causing or permitting another to carry out a licensable marine activity
other than in accordance with a marine licence granted by the Marine
Management Organisation, contrary to s.85(1) Marine and Coastal Access Act


2. The case was heard by District Judge (Magistrates' Courts) Clark in
Liverpool Magistrates' Court. After hearing the prosecution facts, and
mitigation from counsel representing the defendant, the sentence was
ordered as follows:


A fine of £8,000.00

Legal costs of £3,894.22

A victim surcharge of £150.00


TOTAL - £12,044.22


3. The Marine Management Organisation (MMO) cannot comment on matters
relating to Wirral Borough Council employees.
