Dear City of York Council,
Thank you for letting me know the reply is being delayed. I will be particularly interested in viewing the parts of the contracts where contractors were allowed to use quad bikes to deliver weed killer, which has patently failed and not just this year.

Yours faithfully,

Gwen Swinburn

Dear Ms Swinburn,

Following your request dated the 9^th November, I have now completed a
review of the response to your request under the Freedom of Information
Act (FOIA) Please accept our apologies for this late response.

Our understanding of your concerns about your response is:

·        Length of time taken to provide a response.

Review

Our initial interpretation of question 4 was incorrect and caused a
significant delay. The council should have contacted you regarding this
misunderstanding and we apologise for not doing so.

Please see our full response below:

1. Please advise the first year the annual highways weed control contract
was outsourced and provide the committee /Officer report that signed off
the outsourcing.

Information about how and when the first decision to outsource this work
will be held in the records held by the public record office York Archives
at York Explore. You can make arrangements to go and view records of
Council minutes from that period, which will include details of individual
Committee decisions. These are indexed by year.

[1]https://www.exploreyork.org.uk/archives/

2. For Every year since please produce the annual budget for this work and
the contract, performance expectations and the contractor.

2019/20 - A. Morrison’s & Sons £37,020.89.

2018/19 - Munroe’s – 31,189

2017/18 – Munroe’s – 31,189

2016/17 – Munroe’s – 31,189

2015/16 – Munroe’s – 27,192

2014/15 – Dobsons – 68,538

2013/14 – Dobsons – 66,867

2012/13 – Nomix Enviro – 69,792

2011/12 – Nomix Enviro – 79,036

3. For the year prior to the outsourcing of this work please provide the
in-house budget.

We do not hold this information. The budget for in house services does not
break down to this level of detail.

4. For the most recent contract please provide the recorded Information of
the precise procurement modalities (tender, etc.), including who signed
off the contract, the amount and the recorded member/officer decision.

It was procured through request for quotations using the council’s
procurement tender portal.  Evaluated with the lowest quote being
awarded.  This is considered routine procurement and therefore does not
require a member or a recorded decision.

5. For this latest contact please provide details of the payments made and
any payments withheld due to performance failure.

I can confirm that so far the council has paid £18,498.70, the council has
not withheld any payments to date.

6. Please provide evidence for this last contract exactly how the
Executive and or Exec Members were involved in the process

As explained in response to point 4, Member involvement in this process
was not required and therefore this information is not held by the
council. I can however advise that the Head of Operations, believes he
provided a verbal update on the procurement to Councillor Waller, but does
not have any record confirming this took place.

If you remain dissatisfied you can now contact the Information
Commissioner, contact details below:
