Dear Rebecca,

I run the Clean Highways campaign. We aim to encourage the better compliance of duty bodies with EPA S89(1) and (2).

I have been looking at the pioneering work LB Hounslow has been doing with your Highways Maintenance PFI Contract. I have a number of questions and requests for information.

I already have a copy of the Final Business Case and the Performance Targets of which 108, 110 and 112 are of most interest.

Here goes:

1. Am I right in thinking that “Moratorium” refers to an initial period in which the contractor is not obliged to meet the standards set? If not, what does it mean?

2. What does “Core session” mean?

3. 110 says: “The Service Provider shall carry out cleansing activities on the Project Cleansing Network to ensure that the Authority’s score achieves “satisfactory” standard in all elements at Borough level 3 times per year and at Ward level once per year within relevant land uses in accordance with Local Environmental Quality Survey protocols of Keep Britain Tidy.

4. How frequently are these Borough level reports produced? Please let me have a copy of the last 8.

5. How frequently are Ward level reports produced? Please let me have a copy of the last 8.

6. In the Business Case it says ” Vinci-Ringway have demonstrated in their final bid how all Performance Standards will be achieved”. Can please you let me have a copy of the relevant pages from the bid in which this is spelt out in respect to Performance Targets 108, 110 and 112?

7. It goes on to say “In general, Vinci-Ringway will be responsible for self-reporting against service performance, but the client contract management team will work in partnership to monitor and verify outputs”. Please let me have copies of 8 such recent reports covering street cleansing.

8. Can you let me have a copy of the Appendices from the Business Plan. They appear to be missing from the copy on your web site. I am particularly interested in Appendix 20.

Hopefully I am asking for readily available information. If this is not the case please suggest how I might modify my requests to make the task more manageable for you.

A. Please let me have the information requested in the above e-mail.

B. Please let me a copy of any clauses in the contract dealing with the confidentiality of the terms of the contract itself and/ or of any information related to or arising from its implementation

C.Please let me have a copy of any clauses in the contract dealing with the consequences of under- performance and /or penalties - financial or other wise that might be applied.

These requests are not limited to matters dealing with street cleansing.

I believe you should treat this an information request under the Environmental Information Regulations.

Hopefully I am asking for readily available information. If this is not the case please suggest how I might modify my requests to make the task more manageable for you.
