Highways Information Planning Application No. 18/00532/FUL

Was an Independent Traffic Survey carried out in and around the area pertaining to Planning Application No. 18/00532/FUL?

Was a complete assessment carried out regarding the traffic chaos experienced by the residents and school traffic/children on a daily basis for many years?

When was the Construction Environmental Management Plan put in place?

Was the application accompanied by photographic evidence showing the mayhem and commotion experienced by the residents and children attending the school at the top of the road in question?

Why has many of Essex Planning Protocol Development Management Policies not been adhered to?

Is there a 106 Agreement in place?

Why are the covenants protecting the Parker Road Recreational Field being ignored?

As Thurrock Council do not own the Alleyways and Rights of Ways, why do they feel that they can ignore the facts and use them unlawfully?

Was the further information recommended and required by Julian Howes, Highways Development Control, supplied before permission was granted?

Why did Planning Application No. 18/00532/FUL not go before the appropriate/protocol planning Committee ?

Why has so many Conflicts of Interest and incorrect information been allowed in connection with Planning Application No. 18/00532/FUL ?

Thank you for your recent communication which is being managed in line
with the Freedom of Information Act under the above reference number.  The
details of your request are outlined below together with the council’s
response.

Your request and our response

1.    Was an Independent Traffic Survey carried out in and around the area
pertaining to Planning Application No. 18/00532/FUL?

In assessing the application,  the Planning Team sought the views of the
Council’s Highway Team. The application, including all supporting reports
and studies and consultation responses can be viewed at
 [1]www.thurrock.gov.uk/planning.

 

2.    Was a complete assessment carried out regarding the traffic chaos
experienced by the residents and school traffic/children on a daily basis
for many years?

In assessing the application,  the Planning Team sought the views of the
Council’s Highway Team. The application, including all supporting reports
and studies consultation responses can be viewed at

3.    When was the Construction Environmental Management Plan put in
place?

A Construction Environmental Management Plan (CEMP) has not yet been
prepared. This is because it will be undertaken by the main contractor
once appointed. The provision of a CEMP is a pre-commencement planning
condition, and thus will be submitted prior to construction work starting
on site.

 

4.    Was the application accompanied by photographic evidence showing the
mayhem and commotion experienced by the residents and children attending
the school at the top of the road in question?

In assessing the application,  the Planning Team sought the views of the
Council’s Highway Team. The application, including all supporting reports
and studies and consultation responses can be viewed at

5.    Why has many of Essex Planning Protocol Development Management
Policies not been adhered to?

In accordance with national legislation, the application was considered
against Thurrock’s Development Plan policies, taking other material
considerations into account. The report can be viewed at

6.    Is there a 106 Agreement in place?

There is no s.106 agreement associated with application 18/00532/FUL.

 

7.    Why are the covenants protecting the Parker Road Recreational Field
being ignored?

Thurrock Regeneration Limited has undertaken a thorough review of its
legal title and there are no encumbrances preventing Thurrock Regeneration
Limited from using the site as intended.

 

8.    As Thurrock Council do not own the Alleyways and Rights of Ways, why
do they feel that they can ignore the facts and use them unlawfully?

It is not clear what is meant by “the facts” and which alley ways and
Rights of Ways are being referred to. However, the Council has looked into
this matter carefully, and has issued the appropriate notices and made
appropriate application for the use of those areas outlined in
PA18/00532/FUL.  

 

9.    Was the further information recommended and required by Julian
Howes, Highways Development Control, supplied before permission was
granted?

Sufficient information was provided to allow for a decision to be made on
the application. Further information will be secured via the CEMP planning
condition.

 

10. Why did Planning Application No. 18/00532/FUL not go before the
appropriate/protocol planning Committee ?

TRL Ltd is legally a separate entity to Thurrock Council, its directors
would act in that capacity only, and not be party to any delegated Council
decision making process in this matter.  The scheme related to a temporary
access arrangement and was not of a scale that would normally be presented
to Planning Committee. The actual application having gone to Planning
Committee.

 

11. Why has so many Conflicts of Interest and incorrect information been
allowed in connection with Planning Application No. 18/00532/FUL ?

The application was handled following correct procedures and assessed
against the relevant Development Plan policies. Other material
considerations were taken into account but none were sufficient to
outweigh the factors that led to the approval of the application.

I am writing to request an internal review of Thurrock Borough Council's handling of my FOI request 'Highways Information Planning Application No. 18/00532/FUL'.

Why wasn't an Independent Traffic Survey carried out in and around the area. You say you sought the views of the Council's Highway team, pointless unless they had a current/up to date assessment and Survey which the information used clearly showed they DID NOT.

There are no current photos appertaining to this application on Thurrock Council Website/planning that depicts the traffic chaos experienced by the residents and school traffic on a daily basis!

A Construction Environmental Management Plan should have been in place before the planning application was passed by a Councillor as the main contractor is Thurrock Council owned building firm TRL.

Why is there not a 106 Agreement in place?

There are Legal and Binding encumbrances preventing Thurrock Regeneration Limited from using the site as intended and its is shown on the deeds of the Properties in Parker Road. Also Thurrock Council do not own the Unadopted walkways, alleyways and right of ways within the area. So why does Thurrock Council feel they can ignore the facts. The appropriate notices were not issued to those that will be mostly affected, no consultations were held and the information that Thurrock Council say was issued has been denied by those they say received it. The notices they say were printed in the Thurrock Gazette and supposedly tied to a tree with a small piece of string had conflicting information, different dates to contact TC by! Why are the facts being ignored?

Why are you still ignoring the Conflicts of interest and the incorrect information that accompanied the planning application.

TRL is 100% owned by Thurrock Council, financed by Thurrock Council, has Thurrock Council employees as the Secretary and Directors at Companies House and Thurrock Council as its Shareholders. Not classed as a separate entity but is a Conflict of Interest. The scale of the scheme and the time scale is more than enough reason for it to have gone to the appropriate Planning Committee, especially as the actual planning application was shown differently on different requests and correspondence. Why has this all been ignored?

appears that you are unhappy with the way in which the Highways/Planning
department have conducted their business as opposed to the way in which
your FOI request has been answered.

any exemption and we were not late in our reply.  Therefore there are no
grounds to escalate this request to an internal review.
