We refer to your email dated 4^TH FEB 2022, which contained a request for
information as set out in italics below.  Following consideration of your
request, in accordance with the Freedom of Information Act 2000, I respond
to each point as follows:

•            What is the annual spend on this contract?

 

Mayrise- £8,334 – AMX £2,884

 

•            What are the start date & duration of the contract?

 

Both are systems that are part of a continual rolling contract, and have
been in place for a number of years (in excess of 15years) there is no set
duration.

 

•            Is there an extension clause in the contract and, if so, the
duration of the extension?

•            Has a decision been made yet on whether the contract is being
either extended or renewed?

•            Who is the senior officer (outside of procurement)
responsible for this contract?

 

Whilst we can confirm that we hold the information requested regarding
staff members below Corporate Director level, we consider that this
information is exempt under section 40(2) of the Freedom of Information
Act 2000 which states:

 

(2) Any information to which a request for information relates is also
exempt information if—

(a)it constitutes personal data which does not fall within subsection (1),
and

(b) the first, second or third condition below is satisfied.

(3A)The first condition is that the disclosure of the information to a
member of the public otherwise than under this Act—

(a)would contravene any of the data protection principles,

 

Disclosure of the names of individual staff members would breach the first
data protection principle as set out in Article 5 of the General Data
Protection Regulation which states:

 

 1. Personal data shall be

 

 a.       Processed lawfully, fairly and in a transparent manner in
relation to the data subject (‘lawfulness, fairness and
transparency^2);

 

Article 4 of the General Data Protection Regulation states that:-

 

For the purposes of this Regulation: (1) ‘personal data’ means any
information relating to an identified or identifiable natural person
(‘data subject’); an identifiable natural person is one who can be
identified, directly or indirectly, in particular by reference to an
identifier such as a name, an identification number, location data, an
online identifier or to one or more factors specific to the physical,
physiological, genetic, mental, economic, cultural or social identity of
that natural person;

 

The Information Commissioner’s guidance “Access to Information about
public authorities’ employees” and “When should names be disclosed”
provide guidance on how the Authority should treat requests for
information of this nature. The Authority considers the information
requested to be absolutely exempt from disclosure by virtue of Section
40(2) of the Freedom of Information Act 2000.

 

The Authority does not consider that it would be fair in all the
circumstances to identify the individual as whilst the information relates
to them in their professional capacity, they would not reasonably expect
their details to be placed into the public domain. The Authority’s
procedure is not to disclose as a matter of routine information about
members of staff below Corporate Director level.
