Over the weekend of November 6th and 7th and extending into Monday 8th, free traffic flow has been disrupted on Marsh Wall E14, by the Consort Place construction site.

It would appear that a crane was lifting heavy steel components for the construction site.

The CEMP and TMP submitted and approved does not identify these works.

Please provide copies of all correspondence and the authority given for the road to be disrupted.

Thank you for your request for information that was received on 9 November
2021  requesting:

free traffic flow has been disrupted on Marsh Wall E14, by the Consort
Place construction site.
It would appear that a crane was lifting heavy steel components for the
construction site.
The CEMP and TMP submitted and approved does not identify these works.
Please provide copies of all correspondence and the authority given for
the road to be disrupted.
 
We are dealing with your request under the Environmental Information
Regulations 2004  and we aim to send a response by 7 December 2021.
 
In some case, a fee may be payable. If we decide a fee is payable, we will
send you a fee notice and we will require you to pay the fee before
proceeding with your request.
 
The Environmental Information Regulations 2004  may restrict the release
of some or all of the information you have requested. We will carry out an
assessment and if any exceptions  apply to some or all of the information

this is the case and advise you of your rights to request an internal
review and to complain to the Information Commissioner's Office.
 
We will also advise you if we cannot provide you with the information
requested for any other reason together with the reason(s) why and details
of how you may appeal (if appropriate).

Dear Tower Hamlets Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Tower Hamlets Borough Council's handling of my FOI request 'Highway Closure Authority'.

It appears that my FOI has not been adequately responded to.

The actions with regard to the disruption to the public highway along Marsh Wall relate to construction activity and NOT highway works.

I specifically refererenced that these construction works were not identified in the legally submitted CEMP and TMP for this construction site, which form part of the planning appliction, which requires developers to comply with the Tower Hamlets Code of Construction Practice.

A previous FOI reveals that Highways cannot overrule Planning decisions.

There is no reference to permission being granted by Planning for this construction to take place - which has resulted in the closure of the public highway. As pointed out, this operation was not identified in the submitted CEMP or TMP.

It would appear that Highways are not ensuring that the approved CEMP and TMP are complied with. Instead Highways are making unlawful decisions, to close Marsh Wall contrary to the pemitted and approved submissions to Planning. Planning decisions are generally transparent and in the public domain and can be objected to via the planning process ahead of planning approval.

I would like an unambiguous answer with regard to why Highways are not ensuring that the Code of Construction Practice and the approved and submitted CEMP and TMP are not complied with.
