Dear Wirral Metropolitan Borough Council,

We are requesting Wirral Councils Tender Evaluation model that was used in its Highway and Engineering Services Procurement Exercise.

This document has been requested on numerous occasions to your Director of Law, and other senior officers at Wirral Council.

The Audit Commission has informed us that Wirral Council has informed them that we need to follow this FOI procedure.
If you need any further clarification then please contact your Director of Law who will be fully conversant with this issue.

On that basis you will be able to answer this request well within the allocated time frame.

Thank you for your request detailed below.  As per advice, guidance and
good practice, available on the Regulators website at   
[1]http://www.ico.gov.uk/;  Wirral Council is unable to accept any Freedom
  of Information requests, when they are not satisfied that a request has
been made properly under Section 8(1) of the Legislation.  To advice you
further with regard to Section 8(1), it requires a

     requester to use their real name when making a request, for it to

     be a valid request.

     

For example, for someone named John Smith Lewis, the Council would accept
a request made in that name or a variant of it, I have given some examples
below:-

    

     Mr. J. Lewis

     Mr. J. S. Lewis

     Mr. John S. Lewis

     Mr. John Smith Lewis

Wirral Council therefore require you to confirm your real name in order to
progress your request. If you choose not to respond with a valid

name I will assume you have decided not to pursue your request and this
will terminate the request.

Guidance from the ICO is that:

"Where a public authority knows that a pseudonym has been used, as a matter of good practice it should still consider the request, for example where identity is not relevant and it is content to disclose the information requested, even though technically the request is invalid."
