Refusal notice issued under Freedom of Information Act Section 43(2)
Further to your Freedom of Information Request of 7 November 2022, we can confirm that we hold the information you requested but are unable to provide in full.
We have assessed the content against the Freedom of Information Act, the General Data Protection Regulations (GDPR) and the Data Protection Act 2018 and have concluded that we are unable to release the information in full under Section 43(2) of the Freedom of Information Act –Prejudice to commercial interests.
Section 43(2) exempts information whose disclosure would, or would be likely to, prejudice the commercial interests of any person (an individual, a company, the public authority itself or any other legal entity). We believe that disclosing the information requested regarding a break down (by validating partner) of how many students are registered with each partner or are studying a franchised or validated course with each partner would be likely to prejudice our commercial interests. We have also concluded that our Higher Education partners may not expect this information to be disclosed.
We have applied the public interest test and concluded that in this instance we do not believe it is in the public interest to disclose all the information you requested relating to our Higher Education Partners.
We have concluded that it is in the public interest to disclose the total number of Higher Education students and can confirm as follows:
1. Total number of Higher Education students.
The total number of Higher Education students is included in our Annual Report and Financial Statements which are published each year on our website

We currently offer 28 Higher Education courses in total - a combination of Higher Nationals (both Year 1 and Year 2 offer), Foundation degrees (both Year 1 and Year 2 offer) and Top Up degrees.
