Dear North East Lincolnshire Council,

In a document recently considered by the Council's Cabinet a reference was made to bringing university presence to Grimsby.

How many of the Council's statutory officers have a university degree?

How many of the Council's senior managers (chief officer leadership team or equivalent) have a university degree?

Please respond by setting out the number of those with a university degree out of the total. For example if there are 10 statutory officers and six have a university degree then the response would be 6/10.

Many people are qualified by experience instead of, or as well as by having a university degree.

How many of the Council's statutory officers have 3 years or more experience working in a similar role at another Council or public body?

How many of the Council's senior managers (chief officer leadership team or equivalent) have 3 years or more experience working in a similar role at another Council or public body?

Please respond in the same format.

This group of officers are paid extremely well so it is extremely unlikely that there will be any who have neither a university degree nor 3 years or more experience working in a similar role in another Council or public body. Nevertheless please respond in similar format to the following two questions:

How many of the Council's statutory officers have neither a university degree or 3 years or more experience working in a similar role at another Council or public body?

How many of the Council's senior managers (chief officer leadership team or equivalent) have neither a university degree nor 3 years or more experience working in a similar role in another Council or public body.

(b) states the name of the applicant and an address for correspondence, and
(c) describes the information requested.

The Information Commissioner's guidance 'Recognising a request made under the Freedom of Information Act (Section 8)' clearly states that 'the intention of the legislation is for the requester to provide their real name'. Where a request is made not using the applicant's real name this would render the request invalid and affect your appeal rights, as the powers of the Information Commissioner only extend to requests for information defined under section 8 of the Act.

As part of the recruitment process all candidates are assessed based on
experience, qualifications and knowledge. There is no specific recorded
information held by North East Lincolnshire Council which would enable us
to answer your questions below in the way you have stated. To do so would
require a judgement to be made on what is classed as a 'similar role at
another council or public body'. It may be helpful if I explain that the
Freedom of Information Act (2000) gives individuals and organisations the
right of access to all types of recorded information held, at the time the
request is received, by public authorities such as North East Lincolnshire
Council. Section 84 of the Act states that in order for a request for
information to be handled as a Freedom of Information (FOI) request, it
must be for recorded information. For example, a Freedom of Information
request would be for a copy of a policy, rather than an explanation as to
why we have that policy in place. On occasion, North East Lincolnshire
Council receives requests that do not ask for recorded information, but
ask more general questions about, for example, a policy, opinion or a
decision. In this instance I am satisfied that this element of your
request falls outside of the scope of the Freedom of Information Act. I
can confirm that all officers in these posts have been through the
recruitment process which confirms they meet the criteria needed to

Worst thing that ever happened was rob Walsh ex FOI to be put in charge of that coucil they don't have to answer to anything he knows it inside out!!!
