---------

I believe any discussion between Hertfordshire County Council and Land Holdings would be of public interest to be disclosed. As the decisions being made between Hertfordshire County Council and Land Holdings could potentially affected the lives of 1000's of residents in Hertfordshire.

Please remember once information such as an email is received from a private entity to a public entity such as a County council the data can be requested in the scope of the FOI act unless you have a legitimate reason to claim an exemption.

You can also find more information about private email accounts when held on behalf of a the public authority, however it seems likely that they would be stored at a @hertfordshire.gov.uk email: https://ico.org.uk/media/for-organisatio...

Yours faithfully,
Thomas Coward

Dear Hertfordshire County Council,

Where I refer to Land Holdings in the FOI requests this is a mistake, it should have been Lands Improvement Holdings to clarify. This applies to all the FOI requests I've sent previously.

Yours faithfully,
Thomas Coward

Dear Information Governance,

I note your claim to rely on the following rule when aggregating requests:"Due to the similar nature of these requests they will be aggregated into one request with all correspondence sent to the email address provided."

However I would like you to note that you must be very careful when aggregating Freedom of information requests when you believe that they are based on similar or the same information.

According to the ico:
"‘Two or more requests’
41. Public authorities can aggregate two or more separate
requests.

42. They should also note that multiple requests within a single
item of correspondence are separate requests for the purpose
of section 12. This was confirmed by the Information Tribunal
in the case of Ian Fitzsimmons v ICO & Department for Culture,
Media and Sport (EA/2007/0124, 17 June 2008).

43. Therefore a public authority should ensure that each request
can be aggregated in accordance with the conditions laid out in
the Fees Regulations. Any unrelated requests should be dealt
with separately for the purposes of determining whether the
appropriate limit is exceeded. "

I do not believe all of the FOI requests I sent can be aggregated into a single request, as to aggregate one or more requests they must be "made for the same or similar information".

I believe you have haphazardly and incorrectly applied the aggregation rule in this case as you have relied on the requests being made for 'the same or similar information' when this is not the case, most of the requests are not for the same or similar information.

I believe the minimum amount of requests that you could aggregated my 7 FOI requests into is 4 FOI requests, not 1 FOI request. All 7 requests are likely not to return the same of similar information. Please review how you have aggregated the requests before issuing a response to each of the FOI requests. One example of how you have incorrectly applied this rule is as follows:

--------------
Example
These two requests cannot be aggregated for the reason of same of similar information.

FOI request:
"There were some roadworks scheduled recently on Dinant Link road, near the A10 these were overnight works were originally scheduled between the 25th July till 28th July 2018. No work took place on the night of 27th July or the 28th July. Please provide any stored reason as to why the works did not take place overnight on these dates even though they were scheduled to."

FOI request:
"Please state the total amount of complaints you have received since 01/01/2018 till 29/07/2018 regarding noise, dust, building or construction work relating to High Leigh Garden Village, including the roads immediately adjacent to it. Please provide this figure as a monthly break down. "
--------------

I hope you agree with my view point and reconsider how you have incorrectly aggregated the requests into single request.

Yours sincerely,

Thomas Coward

Dear Information Governance,

You state: "You made your request under the Freedom of Information Act, but as your
request concerns information that we feel falls within the definition of
Environmental Information"

However I do not believe this is the case for all of the FOI requests that were.

Please also note:
"Public authorities should note at the outset that requests which
clearly fall under different regimes, for example, the Freedom
of Information Act, the Environmental Information Regulations
or the Data Protection Act, cannot be aggregated. "

Dear Mr Coward,

Reference number: EIR/ENV/07/18/16001

Thank you for your correspondence of 30^th July, I have noted your
comments and I am of the belief that all of your questions should be
considered under the Environmental Information Regulations 2004 as they
concern land development and as such that development will in the course
of that development have an impact on the environment that this is taking
place. Whether that be the requirement for road works to take place,
companies or organisations that have an interest in the development that
affect how that development proceeds, correspondence received and sent
that could impact on the development and complaints received that could
change how the development takes place.

Upon looking at the original questions that you posed I am also of the
belief that the questions that you posed are indeed relevant to be
aggregated, and you questions will be aggregated as follows:

1. There were some roadworks scheduled recently on Dinant Link road, near
the A10 these were overnight works were originally scheduled between the
25th July till 28th July 2018. No work took place on the night of 27th

Permit status: "permit granted" Please provide a copy of the permit that
was granted for these works and how this permit was granted inline with
the The Environmental Protection Act 1990.

Please state the total amount of complaints you have received since
01/01/2018 till 29/07/2018 regarding noise, dust,  building or
construction work relating to High Leigh Garden Village, including the
roads immediately adjacent to it. Please provide this figure as a monthly
break down.

2. Please provide the 5 most recent unique emails or letters received
before or on the 29/07/2018 to Land holdings  (or any
solicitor/organisation acting on Land Holdings behalf)  from any employee
who is employed as an Solicitor at Hertfordshire County Council as stated
on

received by 5 employees it is only to be counted as 1 email/letter in this

Your request for information has been considered under the Environmental
Information Regulations2004 and I can respond as follows:

1. Overnight closures were programmed to take place on the week commencing
23^rd July on the Hoddesdon Link Road for final carriageway resurfacing
works. The eastbound carriageway (towards Hoddesdon from the A10) was
closed from the evening of Monday 23^rd July – Thursday 26^th July between
the hours of 8pm-5am. This was then followed by a closure of the Westbound
carriageway (towards the A10) from the evening of the Thursday 26^th –
Saturday 28^th July between the hours of 8pm-5am. Due to the extreme
weather resulting in high road surface temperatures affecting the cooling
of the newly laid material the decision was taken to cancel the overnight
closure planned on the evening of Friday 27^th July.

I have attached a screenshot of the granted permit from our electronic
permitting system, specific to the works on the westbound carriageway of
Hoddesdon Link Road to which the enquiry relates to.

It seems odd that you have been unable to locate any emails to or from Lands Improvements holdings or any associated third party. Please could you review this and confirm again that no emails have been received by or sent to Lands Improvements Holdings or any associated third party on or before 29/07/2018. You can also process this request as a FOI request rather than under the Environmental Information Regulations 2004.
