HHFT and the Hampshire Health Record

The request was successful.

Dear Hampshire Hospitals NHS Foundation Trust,

I would like to make a request under the FOI Act.

For the purposes of the Act, please take the date of your receipt of this request as Thursday 23rd February 2012.

Back in January 2009, I requested information from you regarding sending clinical feeds to the Hampshire Health Record database.

Your response
http://www.whatdotheyknow.com/request/53...
stated that:

"The Trust is proposing to join the Hampshire Clinical Data Repository (HCDR) in the next financial year."
"The Trust has not started to make visitors aware of the HCDR. The development of a communication plan would form part of the aforementioned formal project."
"Ensuring that the appropriate {opt out] forms are readily available would form part of the aforementioned formal project."

I asked again in May 2010.
http://www.whatdotheyknow.com/request/32...
Your response then was:
"The Trust did not join up to the HCDR/HHR during 2009/10 although discussions are continuing with the PCT."

I asked again in April 2011.
http://www.whatdotheyknow.com/request/67...
Your response then was:

"The Trust did not join up to the HHR in the year 2010/11."
"The Trust has not yet started feeding the HHR with patient data. There is no firm date for when this might start and discussions are ongoing with the HHR project."
"BNHFT does not have a HHR communication plan at this stage but will work with HHR project to develop this at the appropriate time."

It is now February 2012 and I would very much like an update on your progress.

You are of course aware that the data controller for the HHR, Southampton City PCT (SCPCT), will cease to exist in April next year. It has not as yet been decided who the Hampshire Health Record Data Controller or hosting organisation will be from April 2013. The Southampton, Hampshire, Isle of Wight and Portsmouth PCT Cluster "will be developing plans for this transfer during 2012 in conjunction with the Hampshire Health Record Advisory Group and Board" but to date there is no SCPCT closure plan for the HHR data nor any plans to inform individuals of the transfer of their data to the new data controller and/or hosting organisation.

• Please could you state whether your trust did indeed join up to the HHR at some point since April 1st 2011.

• If so, please could you confirm the date that you started feeding the HHR with patient data, or the date that you will start feeding the HHR with patient data if you haven't yet started to.

• Please could you kindly send me your HHR communication plan, which would presumably ensure that (amongst other things):

* You are making visitors aware of the HCDR/HHR feeds via posters and leaflets and your web site, and of their right to opt out
* Opt out forms are freely available from the hospital or downloadable from your website

• Please could you kindly send me a copy of your opt out form, or a link to it.

As per Section 4a of Part 1 of the FOI Act
( http://www.opsi.gov.uk/acts/acts2000/ukp... ) I would like the information in question held at the time when my request is received (draft or otherwise), except that account may be taken of any amendment or deletion made between now and the latest time by which the information is to be communicated to me, being an amendment or deletion that would have been made regardless of the receipt of my request.

I would be grateful if you would be kind enough to send me the requested information promptly and in any event not later than the twentieth working day following the date of receipt of my request.

If my request is denied in whole or in part, or specific items within the responses are withheld from disclosure, then you must justify all deletions by reference to specific exemptions of the act, as per Section 17 of the Act
( http://www.opsi.gov.uk/acts/acts2000/ukp... ). Where you rely on a qualified exemption to withhold disclosure, you are obliged to consider the public interest in your decision and the refusal notice must explain not only which exemption applies and why, but also the public interest arguments addressed in reaching the decision.

I would be grateful if you would kindly acknowledge receipt of this request as recommended by the ICO (“It would be good practice to acknowledge receipt of requests and to refer to the 20 working day time limit, so that applicants know their request is being dealt with”).

Thank you once again.

Kind regards,

Dr Neil Bhatia

Dear Fiona,

Thank you for your response.

Please could you be kind enough to clarify when Basingstoke will commence submitting data to the HHR?

Apologies if I did not make this clear that I was requesting this information in my request (I was aware that Winchester and Andover were submitting data).

Thank you.

Yours sincerely,

Dr Neil Bhatia
