Hexham Bus Station 'Hexham Retail JV' Rural Growth Network Grant

We're waiting for Neville Johnson to read recent responses and update the status.

Dear Northumberland County Council,

I would like to be given further information about the subject of a previous FOI request please.

I understand that a Rural Growth Network grant of £300000 was made in relation to Hexham Bus Station, a joint venture between Northumberland County Council and Dysart Developments Ltd.

The outputs of this scheme were to be

126 Jobs created
2472 sq. m of Commercial Floor space
0.85 Ha to be developed
£8, 700, 000 of follow-on investment
£1, 598, 472 of Public Sector [sic] to be achieved.

The Practical Completion date is 30th September 2018, with Output Completion on 30th March 2019.

Can you inform me as to the progress of this scheme, with reference to the stated outputs?

Can you supply any variance in outputs that may have been defined or agreed since 18th October 2017

Can you state how the grant payment (and/or recovery) will be affected if the scheme has not achieved its previously stated, or later varied, targets?

Is Dysart Developments Ltd a partner in the 'new' Bus Station site, buildings or operations, located on Loosing Hill.

What was the sale price of the 'old' Hexham Bus Station on the Priestpopple site, when it left NCC ownership?

What is the purchase price for the 'old' Hexham Bus Station on the Priestpopple site?

Will this site, when bought, be owned by Northumberland County Council?

I refer to your Freedom of Information request in relation to Hexham Bus
Station.

Right of Access

Section 1(1) of the Act provides any person making a request for
information to a public authority is entitled.

(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request (which Section
1(6) of the Act designates as the "duty to confirm or deny"), and

(b) if that is the case, to have that information communicated to him.

The right is to obtain access to the information itself and not to the
document or record which contains it.

The Act creates a general right of access to information held by public
authorities subject to various exemptions.

Northumberland County Council confirms that it holds the information you
have requested, please see the following information in response.

In terms of the stated outputs, so far claimed are 1.5 FTE jobs directly
connected to the intervention and £1,533,755.90 of public sector
investment as match funding achieved.

There has been no variance in outputs, defined or agreed since 18th
October 2017.
Can you state how the grant payment (and/or recovery) will be affected if
the scheme has not achieved its previously stated, or later varied,

The project and scheme is ongoing, the NERGN Executive will decide on
recovery action if the project fails to achieve its stated targets within
the lifetime of the RGN programme.
Is Dysart Developments Ltd a partner in the 'new' Bus Station site,
buildings or operations, located on Loosing Hill.
Dysart has no involvement at all in the new bus station

What was the sale price of the 'old' Hexham Bus Station on the
Priestpopple site, when it left NCC ownership?

The sale price for the old bus station site on Priestpopple was £500,000.

Duty to confirm or deny

Northumberland County Council confirms that we holds certain information
relating to your request.

Exemptions

The Freedom of Information Act sets out various exemptions to the right of
access.

In the present case the County Council takes the view that the information
is exempt under section 43 on the basis that it is commercially sensitive.
In this case the Authority relies on section 43(2).

Freedom of Information Act 2000 Section 43(2): Information is exempt
information if its disclosure under this Act would, or would be likely to,
prejudice the commercial interests of any person (including the public
authority holding it).

Public Interest Test Considerations

Section 43 is a qualified exemption which means that the information
falling within the exemption still has to be released unless the public
interest in disclosure is outweighed by the public interest in maintaining
the exemption.

The reason why the public interest favours withholding the information is
that the sale of the bus station has not yet taken place.

Advice and Assistance

The County Council recognises its statutory duty to provide advice and
assistance under Section 16 of the Act.

Subject to the provisions of the Freedom of Information Act, the Council
is seeking to be transparent and open in its response. As you will
appreciate we are constrained by the requirements of the legislation. .

With the exception of the limited information disclosed herewith, please
treat this as a section 43(2) Exemption.
