Your request for information has been considered under the Freedom of
Information Act 2000.  I can confirm that Hertfordshire County Council
does hold the information you have requested.

 

Questions 1 and 2

Hertfordshire County Council considers that such information is exempt
from disclosure under Section 43(2) of the Freedom of Information Act
2000, relating to commercial interests.  In applying this exemption
Hertfordshire County Council has balanced the public interest in
withholding the information against the public interest in disclosure.

 

The factors we have considered which are in favour of disclosure are:

 

·         The public interest in allowing scrutiny of how public money is
spent and ensuring value for money when purchasing services;

·         Disclosure may facilitate the accountability and transparency of
Hertfordshire County Council for decisions it takes, including around the
procurement process;

·         Disclosure may allow individuals to better understand decisions
made by Hertfordshire County Council affecting their lives and, in some
cases, assist individuals in challenging those decisions.

 

The factors we have considered which are against disclosure are:

 

·         The information is commercial in nature;

·         Disclosure of the withheld data would, or would be likely to,
cause detriment to the commercial interests of the companies which
submitted tenders for this contract by giving competitors a commercial
advantage;

·         There is an inherent public interest in allowing fair
competition between private sector organisations for public sector
contracts and the disclosure of commercially sensitive information would,
in this instance, be very likely to put the companies which submitted
tenders for this contract at a commercial disadvantage;

·         There is a public interest in maintaining good relations between
Hertfordshire County Council and the successful tenderer, INIT GmbH – the
disclosure of sensitive commercial information would be likely to damage
the working relationship between the two organisations and could
potentially inhibit the delivery of the contracted services;

·         There is a public interest in ensuring that any future
bargaining position which Hertfordshire County Council may have is
maintained, resulting in the effective use of public money.

 

On balance, we consider that the public interest does not favour
disclosing the requested information as it would, or would be likely to,
prejudice the commercial interests of both Hertfordshire County Council
and the companies which submitted tenders for this contract.  Disclosure
of such data would negate the whole purpose of the tendering process and
inhibit future working relationships.  Additionally, disclosure could
affect Hertfordshire County Council's ability to obtain the best rates for
similar contracts in the future.  Finally, it is believed that the
disclosure of the requested information would be likely to affect the
tendering companies’ ability to successfully tender for any renewable
contract with, not only this Council, but any other similar contracts for
which they may be in the process of tendering.

 

Question 3

Hertfordshire County Council has procured the quantities in the ITT with
exception of the proposed private mobile radio system which was replaced
with a less expensive technology.
