Dear Canal & River Trust,

I refer to the minutes of the Canal and River Trust Quarterly Grant Agreement Meeting
Wednesday 9 December 2020, Section 8 Any Other Business -

CRT sought Defra’s views on a draft letter to the Secretary of State explaining the
absence of Heritage asset data in the required Publication Data in the Annual
Report, which was due to Covid-19 disruption to surveys usually conducted to
collect the data. Defra agreed to respond with any comments in due course.

Action: Defra to provide CRT with comments on the draft Heritage data
letter to the Secretary of State, and then CRT to issue this letter

I am writing to request an internal review of Canal & River Trust's response to my FOI request 'Heritage letter from CRT chair to the Secretary of State' on 21 September 2021.

Contrary to your delayed response, the quoted minutes confirm that the requested letter exists. Indeed, on 24 August I wrote to you -

"For the avoidance of doubt, the letter is from your chair Allan Leighton. I would also expect that Tom Deards holds a copy."

I would therefore ask that the reviewing officer approach these two for a copy of the letter, informing them that I am making enquiries via my MP related to this matter.

Please either -

- provide me with the letter

or

- or a statement from either Mr Leighton or Mr Deards that a letter was not sent.

I look forward to early provision of this draft letter and also the letter in its final form.

I have reread what you said - " .....the letter you refer to was not sent to Defra in final form". Assuming you meant the SoS, this could this could be interpreted as CRT sending an earlier version of the letter.

As I am sure that you would have sent the letter using Mr Leighton's electronic signature and he would have been aware that it was sent, a simple "The letter you refer was not sent to the SoS " from you or better still the silent Mr Leighton would give me some assurance.

I am sorry to be pedantic but CRT would have me believe the opposite of what the minutes state.

I refer to the email below sent to you on 06/10/2021, 08:39. The email was copied to Tom Deards.

The minutes of 9 December show that the letter was sent. CRT would have me believe that the action was marked as "completed" because it was not completed!

You have remained silent. Mr Deards has tried to muddy the waters some more but seems unwilling to give a categorical assurance "the letter you refer to was not sent to the Secretary of State".

Maybe this is because he knows the legal ramifications should such a statement prove untrue.

In the absence of Mr Deards providing such a statement I would ask that you either provide me with:

a copy of the letter you sent

or

a statement "the letter you refer to was not sent to the Secretary of State"

Following your statement "I am happy to give you a categorial [categorical] assurance that the letter you refer to was not sent to the Secretary of State." , I am marking this request as "they do not have the information".

However, I note that your statement was not accompanied by the two letters I have you to provide as relevant to this request - surely just a case of attaching them.
