Response to this request is long overdue. By law, under all circumstances, Police Scotland should have responded by now (details). You can complain by requesting an internal review.

Dear Police Scotland,

The Freedom of Information (Scotland) Act 2002 gives a general right of access to all types of recorded information held by public authorities, sets out exemptions to that right and places a number of related obligations on public authorities, particularly in relation to Records Management and Publication Schemes.
As of 1 January 2005, people have had the right to make a request for information and be informed whether or not the public authority holds that information and, subject to various statutory exemptions, be supplied with that information.

I would therefore like to make the request that-
You provide details of the exact amount of people each of the 13 Divisions of Police Scotland has held on Police Bail for 6 months or more without charge, between the dates of:
01 April 2017-2018
01 April 2016-2017
01 April 2015-2016
01 April 2014-2015
01 April 2013-2014.

To reiterate. You provide, under the freedom of information laws, details for each separate division of Police Scotland for each tax year (from 1st April) of how many people each division held on Bail for a total 6 months or more without charge.

I have faith that under the laws of transparency and honesty, this request will not pose too much of an issue.

I am writing to request an internal review of Police Scotland's handling of my FOI request 'Held on Police Bail for 6months or more without charge.'.

Somebody somewhere must have information relating to the amount of time an individual can be held on Bail in Scotland.
Please do not tell me that Bail does not exist in Scotland as I have dozens of pages of text from the Scottish Police Authority, COPFS and Police Scotland which clearly and repeatedly states -
Mr Barton ..Your Bail Conditions, You are on Bail, Held on Bail For 11 months etc etc.

RESPONSE FROM CROWN PROCURATOR FISCAL for same request:
Dear Mr Barton,
We would refer you again to the information in our FOI response dated 11 October 2018 (Ref: R019284).
Regarding your related enquiry we can only restate that the Crown Office & Procurator Fiscal Service:
• does not record the information you have requested
• does not know of any other authority where you might obtain the information.
We note that Police Scotland have advised you Police Bail does not exist outside England and Wales which may explain why the information is not recorded in Scotland.

SCOTTISH POLICE AUTHORITY RESPONSE TO SAME:

Dear Mr Barton
Your request for information has been considered and the Scottish Police Authority (SPA) is able to provide the following.
The Scottish Police Authority are the governing body for Police Scotland, and have no access to Police Systems.
Therefore this represents a notice in terms of:
Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held.

POLICE SCOTLAND RESPONSE TO SAME:
Our Ref: IM-FOI-2018-2368 Date: 08 November 2018 .
Dear Mr Barton,
In relation to the above request I must respond in terms of Section 17(1) of the Freedom of Information (Scotland) Act 2002: Information not held.
To explain, “Police Bail” does not exist in the Scottish legal system.
In England and Wales a system of “Police Bail” is operated under the Police and Criminal Evidence Act (PACE) and gives Police the power to arrest and liberate as required during the course of an investigation. When releasing a suspect on investigative liberation they may apply conditions and require a person to re-attend at a Police Station on certain dates.
There is no such system used in Scotland, and the release of an offender falls under the jurisdiction of the Scottish Court Service (SCS) and the Crown Office and Procurator Fiscals Service (COPFS).

THERE IS CLEARLY BAIL IN SCOTLAND AS I HAVE BEEN HELD ON BAIL FOR 11 WHOLE MONTHS!
STATED CLEARLY IN DOCUMENTATION FROM SCOTTISH SOLICITORS, COURTS, POLICE etc.etc.

So the question is-
Do You Hold on File: Records of the Lengths of Time you Hold Innocent People on Bail in Scotland Without Charge - or KNOW OF ANY OTHER AUTHORITY WHICH DOES?
