Hi I have received only a partial reply to my FOI - Estates Department were to let me have the details of costs of repairs to the building. They have not complied with their legal obligation to supply information within the set time frame. In the meantime I am requesting an internal review. I initially put this FOI in May, but I have yet to receive a reply in regard to the state of repair, cost etc of Billinge library. I am still waiting, I was advised Estates Department would update me with these. They have not. I am led to believe that at last months Billinge Parish Council meeting there was mention of a survey of the building? Has that happened? Can a copy of this be provided? I think I have been more than patient and in view of the fact that the Library is now empty it is only fair that answers are forthcoming. It is also noted that the internal review requested has not yet been actioned/updated.

I am writing to request an internal review of St Helens Metropolitan Borough Council's handling of my FOI request 'Health and Safety Risk Assessment Garswood Library'. Although I was initially supplied details, the last part of the request cost/extent of repairs to Billinge Library, wh (now stripped out and has no books or shelves). Estates Department was going to let me have this information, but has failed to do so - maybe after November's announcements it will be deemed not necessary - but it is and the information is required.

I note that you have not confirmed or denied whether the authority holds this information, and have not applied an exemption that would remove this obligation.
As you may be aware, Section 1(1) of the FOI Act (https://www.legislation.gov.uk/ukpga/200...) states that "Any person making a request for information to a public authority is entitled to be informed in writing by the public authority whether it holds information of the description specified in the request".
I would be grateful if you could clarify whether or not this information is held, or specify which exemption of the duty to confirm or deny you are applying.

Matthew Lockett left an annotation ()

They are generic risk assessments, with the exception on the final pages where they mention the square footage and layout of the libraries.

They also say they will be reviewed when the libraries re-open, but are dated 24th July 2020.

Surely as Garswood library has now reopened there should be a more recent risk assessment?

Please respond to the FOI in terms of please send a copy of the survey that has been carried out on the building and the roof in which the conclusion is that the building is 'not fit for purpose'.

There is a legal obligation to respond to FOIs in a specific time frame, and it matters not how many people have left the organisation this does not negate responsibility from adequately responding.

I am now requesting a second internal review for this matter, the first one was ignored - the ICO is aware.
