My response is as follows:

 

There has been no correspondence on the HDV between the External Auditor
and Cllr Blake outside of the Corporate Committee which is publically
documented. I have attached two emails. The first is from Cllr Kober to
senior officers at the Council forwarding an email she had received as a
cc from a member of the public to the External Auditor relating to the
HDV. The second email is from Cllr Strickland which was a cc to him from
the Chief Operating Officer with the answers to a Members Enquiry relating
to the HDV. There is no other correspondence.

The meeting did go ahead.  Diaries show that as well as the External Audit
team from BDO, the following Council officers were invited: Chief
Executive, Chief Operating Officer, Strategic Director of Regeneration,
Planning and Development, Assistant Director for Transformation and
Resources, Director of Regeneration, Director of Housing & Growth,
Assistant Director for Corporate Governance, and Head of Audit and Risk
Management and two external Council advisers.  There are no minutes of the
meeting.  The meeting consisted of a presentation by the Council team to
the BDO team during which clarification questions were asked and
answered.  The slides used for the presentation are attached, with some
redaction for commercial sensitivity.

I am writing to request an internal review of Haringey Borough Council's handling of my FOI request 'HDV correspondence and meetings between External Auditor and Cllrs'.

I am not satisfied that the information provided is complete. Important information that should be available to the public is redacted namely all 3 pages relating to Tottenham Hotspur Football Club. There is considerable public concern about significant public funds already being given to this private company, also widespread concern about the secrecy applied to many of Haringey's deals with the private sector. This is yet another example. Correspondence quoted below evidences Haringey's awareness of this specific issue. Failure to disclose the explanation of the link or otherwise between Spurs and the HDV adds further concern that this is indeed an area that Haringey wish to conceal. Rules on Transparency clearly state that public scrutiny is an aid to prevent fraud and that commercial confidentiality is not an automatic reason to prevent the disclosure which goes against the required presumption of openness. I provide an excerpt from the Transparency Code below to evidence this claim.

In the FOI response dated 4th May (link provided below) an email dated 10/4/17 Subject External Audit, from Tracie Evans Chief Operating Officer for Haringey Council states, in regard to the external Auditor Mr Leigh, 'Leigh's other comment is that the public seem to think that the reason we are having to make a quick decision is because we have done a 'dodgy deal' with Spurs so it would seem that some members of the public are conflating the HRW scheme with the HDV.'

To deny public access in this way can only increase the public concern quoted that there is indeed a link between Spurs and the HDV a fact often denied by Haringey.

Commercial confidentiality
20. The Government has not seen any evidence that publishing details about contracts entered into by local authorities would prejudice procurement exercises or the interests of commercial organisations, or breach commercial confidentiality unless specific confidentiality clauses are included in contracts. Local authorities should expect to publish details of contracts newly entered into –commercial confidentiality should not, in itself, be a reason for local authorities to not follow the provisions of this Code.

22.Local authorities should start from the presumption of openness and disclosure of information, and not rely on exemptions to withhold information unless absolutely necessary.

Can you please clarify what exactly you wish us to review.

I have checked the response that was sent to you and the two attachments.
I can't see that any information was redacted. Also the response itself
does not say that information  was redact or quote an exemption that would
have allowed us to withhold information.

 

It seems that the emails were scanned as double-sided and there are blank
pages in the attachments. Can  you please clarify if the blank pages are
what you consider as having been redacted.  If not please clarify what
information you believe has been withheld/redacted.

 

 

Please note that we will take no further action on this request until we

Thank you for your response I apologise for my delayed reply as I have been away. Your response is very confusing. If you look back on the record held on What do they know.com you will see that I recieved only one attachment namely 'Presentation to External Auditor' the pdf pages 23, 24 and 25 were headed THFC and blank apart from the word in brackets 'redacted material'. That is the basis of the review I have requested and refer you back to the grounds submitted in my origional request. You have raised the issue of a second attachment of email copies. I did not receive that and certainly having looked again at the response can still not locate any second attachment. I may of course be misreading this so will be grateful if you can either point out the location of second attachment or resend it to me in order that I may study the contents of said emails.
