As per your request, we have searched for information between the senior
mangement at both Homes for Haringey and London Borough of Haringey
regarding the proposed HDV between the period 1^st April 2016 and 1^st
April 2017.

 

Please note that we will not be attaching the emails you requested but
will list the information contained within in them.  This is for two
reasons:

1.    There is personal data contained in the emails

2.    We have automatic electronic archiving which archives emails after
three months. This means that the emails cannot be opened by any other
than the sender.

 

The FOIA states that the the requester is entitled to the information

The emails of members of staff and officers of Haringey Council are not protected as personal information when carrying out their employment or elected functions. I have no interest in seeing the personal details of any individual who is not an elected member, officer or employee of the Council insofar as their emails pertain to the functioning of the Council, its decision making or dealings with external agencies. I would respectfully request that the emails be redacted of any genuinely "personal information" as defined by law and the remainder of the content released.

I appreciate that the manner in which the Auto Archive function of the organisations involved may present some challenges, but that does not however override the legal requirement to disclose. You have a legal duty to retain records for a minimum of six months and having an individual member override undermines the principle of freedom of information. You may wish to talk to your I.T department, the fact that the Auto Archive is set up in such a manner as to make legal compliance difficult, i concur, that is an issue.

Thank you for your patience whilst waiting for my reply.  In relation to
the IT point – I would like to reassure you that notwithstanding the IT
policies, all relevant emails have been reviewed and relevant information
provided.  Our policy is to archive after three months but the archived
emails are fully searchable and accessible by the staff member whilst in
the archive. 

 

Turning to the emails you requested, the Act does not require copies of
documents to be provided only details of the information contained in the
document.  Bearing that in mind and having duly considered your response
and the relevant FOIA exemptions and data protection principles, I have
added the names of employees in a senior/in a public facing role (e.g.
elected members, board members or other management).  If employees on the
trail were not in these roles I have left their names off the distribution
or referred to them as a junior employee (the provision of their
information is exempt in the circumstances, pursuant to section 40(2) of
the FOIA).  In some instances I still need to confirm the full
distribution list and I will update this shortly.

 

I would like to apologise for an oversight in the original email.  There

You claim that the Freedom Information Act does not require you to supply copies of emails, only the information held within. I believe that your interpretation of the law is incorrect and your response inadequate in several ways.

I have read the legislation and can find no section that specifies that you may refuse to provide copies of the information simply because the original recording format is email. Emails are routinely supplied by relevant authorities in response to FOI including Haringey Council. The format you have used to respond in any case does not include the information only a summary of the topic and authors and recipients of the information.

I draw your attention to section 84 F3 of the Act which provides interpretation of the wording within. I quote 'infomation subject to sections 51(8) and 75(2) means information recorded in any form'

The act lists those elements that may be subject to exemption, copies of email do not appear as legitimate grounds for refusal. You are required to state the specific exemption you apply when refusing information, you have not done so.

Indeed under section 77(1) the act states that it is an offence (ie criminal) to 'alter, deface, block, erase, destroy, or conceal any record held by the public authority with the intention of preventing disclosure'.

It seems that you are in danger of being assessed as falling foul of the allegations of blocking and or concealing records with the intention of preventing disclosure. Whilst this may not be the intention, the continued failure to provide the requested information forces me to ask again for the prompt supply of copies of all emails listed in your previous responses. If you remain unwilling to do so I must ask for an immediate internal review and give you fair notice that I do intend to pursue this if refusal continues.

Indeed under section 77(1) the act states that it is an offence (ie criminal) to 'alter, deface, block, erase, destroy, or conceal any record held by the public authority with the intention of preventing disclosure'.

It seems that you are in danger of being assessed as falling foul of the allegations of blocking and or concealing records with the intention of preventing disclosure. Whilst this may not be the intention, the continued failure to provide the requested information forces me to ask again for the prompt supply of copies of all emails listed in your previous responses. If you remain unwilling to do so I must ask for an immediate internal review and give you fair notice that I do intend to pursue this if refusal continues.

In relation to the IT point – I would like to reassure you that notwithstanding the IT policies, all relevant emails have been reviewed and relevant information provided. Our policy is to archive after three months but the archived emails are fully searchable and accessible by the staff member whilst in the archive.

Turning to the emails you requested, the Act does not require copies of documents to be provided only details of the information contained in the document. Bearing that in mind and having duly considered your response and the relevant FOIA exemptions and data protection principles, I have added the names of employees in a senior/in a public facing role (e.g.
elected members, board members or other management). If employees on the trail were not in these roles I have left their names off the distribution or referred to them as a junior employee (the provision of their information is exempt in the circumstances, pursuant to section 40(2) of the FOIA). In some instances I still need to confirm the full distribution list and I will update this shortly.

I would like to apologise for an oversight in the original email. There were four emails from 2016 which were inadvertently left off the previous email and have now been included. In addition, there was one typo on the date.

You claim that the Freedom Information Act does not require you to supply
copies of emails, only the information held within.  I believe that your
interpretation of the law is incorrect and your response inadequate in
several ways.

 

I have read the legislation and can find no section that specifies that
you may refuse to provide copies of the information simply because the
original recording format is email.  Emails are routinely supplied by
relevant authorities in response to FOI including Haringey Council.  The
format you have used to respond in any case does not include the
information only a summary of the topic and authors and recipients of the
information.

 

I draw your attention to section 84 F3 of the Act which provides
interpretation of the wording within.  I quote 'infomation subject to
sections 51(8) and 75(2) means information recorded in any form'

 

The act lists those elements that may be subject to exemption, copies of
email do not appear as legitimate grounds for refusal. You are required to
state the specific exemption you apply when refusing information, you have
not done so.

I recently received a response to my request for copies of correspondence between Homes for Haringey and Haringey Council and officers regarding the HDV. Please provide all communications between Homes for Haringey senior
management and Haringey Council regarding the proposed HDV between the

The response you received listed a number of emails that had been
identified and summarised their contents.

 

We agree that the response was not compliant with the Freedom of
Information Act in that it did not provide the information that you had
asked for. You are correct to state that it is normal for public
authorities to disclose the actual emails when responding to requests such
as yours. It is also correct that if a public authority withholds
information, we must state the specific exemption/s that we are relying
on.

 

We will therefore provide a further response and release the actual emails
listed in the initial response, subject to any exemptions. Where we rely
on any exemptions, we will fully explain which exemption and why we
believe it is applicable, including any considerations of the public
interest. We will require some time to review the emails and consider any
applicable exemptions and the public interest so propose to send you our
