Dear South Hams District Council,

I would like to know has the Council Anti Social Officers been fully trained on.

1) Hate Crime S28 crime and disorder Act 1998 including all sub groups? Including disability hate crimes?

2) The meaning of Indecent behaviour?

3) When anti social behaviour is a public order offence? The public order act 1986 Ambit of section 5 of the Governments Anti Social officers hand book 7.6?

4) has your officers been trained to and understands, The right to respect for private and family life, his home and his correspondence? Article 8 of the human rights Act

5) Would it be a breach of question (4) if one of your officers entered a gated area unlocked a gate to be there and then proceeded to take photos on private land without any concent?

6) Have your officers been given full training about breaching a persons right to have words or written words kept private under data protection laws? And what the council would do if a officer breached right to confidental conversation with a third party?

Thank you for your email of 5 July 2014 where you requested information about Hate Crime and Anti Social Laws. I note your earlier email on this request but would confirm that the Freedom of Information Act requires a response with 20 WORKING days and today, 1 August2014 is the 20th Working day since the date of your request.

In answer to your questions, I can confirm that that appropriate training is provided to SHDC officers in handling the particular issues you describe (Anti-Social Behaviour, Data Protection Act etc) and falls within the responsibility of the section, or department to arrange and maintain. The Council would follow the procedures required by the terms of the Data Protection Act should any breach of such be deemed to have occurred.

If you are dissatisfied with the handling of your request, you have the right to ask for an internal review. Internal review requests should be submitted within two months of the date of receipt of the response to your original email and should be addressed to Becky Fowlds, Solicitor, email: [email address]

I do not feel that all the information that I am allowed has been given, meaning the governments zero policy on anti social behaviour that my family is having to deal with and the council not following the laws laid down for them to follow.
